9B.\nNovember 18, 2025\nCONSIDERATION OF A RESOLUTION AUTHORIZING THE CITY MANAGER\nTO NEGOTIATE, FINALIZE AND EXECUTE A LEASE AGREEMENT WITH THE\nDEPARTMENT OF HOMELAND SECURITY CUSTOMS AND BORDER\nPROTECTION AGENCY FOR THE INSTALLATION AND OPERATION OF A\nMARITIME SURVEILLANCE SYSTEM ON CITY-OWNED LAND AT THE\nRESERVOIR 5 COMMUNICATIONS SITE (APN 690-502-16 AND 690-502-12),\nAND FINDING THE ACTIONS EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-180, which will:\n1. Determine that the actions are categorically exempt from the California\nEnvironmental Quality Act (CEQA) under Class 3, Section 15303 of the state\nCEQA Guidelines (14 CCR 15303).\n2. Authorize the City Manager to negotiate, finalize and execute a lease\nagreement with the Department of Homeland Security Customs and Border\nProtection Agency (CBP) for the purpose of installing and operating a\nmaritime surveillance system at the Reservoir 5 Communications Site based\non the following key terms:\na. 20-year term, with (2) five-year extensions.\nb. $10 per month rent.\nc. City to pay electrical costs.\nd. CBP to pay for equipment and installation costs.\ne. CBP and City staff to agree on facility dimensions, design and\nplacement.
