H. AMENDMENT OF SERVICES AGREEMENT WITH THE LEW EDWARDS\nGROUP AND FM3 RESEARCH TO PROVIDE BALLOT MEASURE POLLING\nAND PUBLIC OUTREACH SERVICES\nOn October 21, 2025, the City Council authorized the City Manager to enter\ninto a Professional Services Agreement with The Lew Edwards Group (LEG) and\nFM3 Research to provide ballot measure feasibility services, including opinion\nresearch and strategic communications support. As LEG and City staff began\nfinalizing the agreement, two minor but important clarifications to the contract\nlanguage were requested by LEG. These updates are consistent with best\npractices in municipal ballot measure consulting agreements and are intended\nto ensure clarity regarding ownership of work product and scope of services.\nThere is no fiscal impact associated with the proposed contract amendments.\nThe not-to-exceed amount previously approved up to $171,250.00 assuming\ntwo surveys and a November 2026 General Election remains unchanged.\nCalifornia Environmental Quality Act (CEQA) Determination: This item is not a\nproject as defined in Section 15378 of the State CEQA Guidelines, as it has no\nreasonable potential for significantly impacting the environment.\nRecommended Action:\nStaff recommends that the City Council:\n1. Approve the amendment to the Professional Services Agreement with The\nLew Edwards Group and FM3 Research to include:\no the clarified ownership of work product language; and\no the addition of a sentence specifying that legal services are not\nincluded within the consultant’s scope of work.\n2. Authorize the City Manager to execute the contract amendment.
