(34)\n17-0653-S1\nCOMMUNICATION FROM THE CITY ATTORNEY and ORDINANCE\nFIRST CONSIDERATION relative to amending Sections 104.03 and\n104.06 of Article 4, Chapter X of the Los Angeles Municipal Code\n(LAMC) to regulate Commercial Cannabis Activity.\nRecommendations for Council action, SUBJECT TO THE APPROVAL\nOF THE MAYOR:\n1. RELY on Negative Declaration No. ENV-2017-2261-ND,\nadopted on November 28, 2018, to approve the project. Find,\npursuant to the California Environmental Quality Act (CEQA)\nGuidelines Section 15162(b), there are no substantial changes\nto the project, substantial changes to the circumstances or new\ninformation that will require the preparation of an Environmental\nImpact Report. Based on the whole of the administrative record,\nthe ordinance is exempt pursuant to CEQA Guidelines Sections\n15301 (categorical exemption for existing facilities) and 15303\n(categorical exemption for new construction or conversion of\nsmall structures), and that none of the exceptions under\n15300.2 apply. Reliance on a categorical exemption is\nappropriate when substantial evidence in the record supports a\nproject falls within the categorical exemption and the City\ndetermines that none of the exceptions in CEQA Guidelines\nSection 15300.2 applies.\n2. PRESENT and ADOPT the accompanying ORDINANCE dated\nDecember 9, 2025 amending Sections 104.03 and 104.06 of\nArticle 4, Chapter X of the LAMC to regulate Commercial\nCannabis Activity.\nFiscal Impact Statement: None submitted by the City Attorney.\nNeither the City Administrative Officer nor the Chief Legislative\nAnalyst has completed a financial analysis of this report.
