(55)\n25-1424\nPUBLIC SAFETY and BUDGET AND FINANCE COMMITTEES’\nREPORT relative to developing a permanent City policy for waiving\nrebuilding fees for residents affected by natural disasters to ensure a\nconsistent and equitable approach to disaster recovery.\nRecommendations for Council action, pursuant to Motion (Rodriguez\n– Lee):\n1. INSTRUCT the City Administrative Officer (CAO) and Chief\nLegislative Analyst (CLA), with the assistance of the City\nAttorney and all relevant City departments, to develop and\nreport to Council on a permanent City policy for fee waivers for\ndisaster-impacted residents, including those affected by\nwildfires, floods, earthquakes, and other declared emergencies.\nThe report should include the following:\na. Identify eligible fee types, including building, plan-check,\ndevelopment impact, and related fees; and, define\neligibility criteria for affected property owners.\nb. Include considerations to differentiate benefits based on\nwhether property owners are insured, underinsured, or\nuninsured.\nc. Establish safeguards, such as fee caps or project scope\nlimitations, to prevent unintended fiscal impact on other\nresidents or departments.\nd. Provide mechanisms to coordinate with the Federal\nEmergency Management Agency, California Governor’s\nOffice of Emergency Services, or other funding sources to\nrecover waived fees where possible; and, identify\ncontingency funding sources if reimbursement is\nunavailable.\n2. REQUEST the City Attorney to report to Council with a draft\nordinance implementing this permanent disaster fee policy.\nFiscal Impact Statement: Neither the CAO nor the CLA has completed\na financial analysis of this report.
