(1)\n25-0095\nCD 11\nENVIRONMENTAL IMPACT REPORT (EIR), MITIGATION\nMONITORING AND REPORTING PROGRAM (MMRP), STATEMENT\nOF OVERRIDING CONSIDERATIONS, and CITY ENGINEER\nREPORT relative to the vacation of 96th Street between Sepulveda\nBoulevard and Jetway Boulevard, Vicksburg Avenue between 98th\nStreet and 96th Street, and a portion of the easterly side of Sepulveda\nBoulevard from approximately 150 feet southerly of 96th Street to\napproximately 575 feet northerly thereof, VAC- E1401456, (Project).\nRecommendations for Council action:\n1. ACKNOWLEDGE that the vacation of the areas shown colored\norange on Exhibit B of the Bureau of Engineering (BOE) report\ndated December 22, 2025, attached to the Council file, are no\nlonger part of the request. These areas were withdrawn from\nthe request by the applicant in their letter dated August 21, 2025\n(Transmittal No. 7 of said BOE report).\n2. REVIEW and CONSIDER the Los Angeles International Airport\n(LAX) Airfield and Terminal Modernization Project (ATMP) EIR\n(consisting of the Draft and Final EIR), dated October 2020 and\nAugust 2021 (Transmittal No. 1 of said BOE report), and\nAddendum to the ATMP EIR, dated December 2024 (State\nClearinghouse No. 2019049020) (Transmittal No. 2 of said BOE\nreport), which was prepared by Los Angeles World Airports\n(LAWA) in compliance with the California Environmental Quality\nAct (CEQA).\n3. FIND under CEQA Guidelines Section No. 15091, that changes\nor alterations have been required in, or incorporated into, the\nProject that mitigate or avoid significant effects on the\nenvironment as identified in the Final EIR and the ATMP MMRP\n(Transmittal No. 3 of said BOE report), dated August 2021, and\nas set forth in the CEQA Review Memo, dated September 25,\n2025 (Transmittal No. 4 of said BOE report). A Copy of Notice of\nDetermination (Transmittal No. 5 of said BOE report) which\ndocuments LAWA’s certification of the ATMP EIR and adoption\nof the ATMP MMRP is attached and incorporated herein.\n4. CONCUR with the Board of Airport Commissioners’ findings that\nthe unavoidable significant adverse impacts associated with the\nproposed Project are acceptable in light of the economic, legal,\nsocial, technological, and other benefits the proposed Project\nwill bring to the surrounding community and LAWA. These\nspecific overriding considerations are described in the\nStatement of Overriding Considerations for the LAX ATMP,\ndated September 2021 (Transmittal No. 6 of said BOE report),\nand is attached and incorporated herein.\n5. FIND that no new information exists to show that the Project or\ncircumstances of the Project have been changed to require\nadditional environmental review, under the California Public\nResources Code, Section No. 21166, and State CEQA\nGuidelines Section No. 15162, and therefore the existing\nenvironmental documents adequately describe the potential\nimpacts for this street vacation.\n6. FIND that street vacation proceedings pursuant to the Public\nStreets, Highways and Service Easements Vacation Law be\ninstituted for the vacation of the public right-of-way indicated in\nsaid BOE report and shown colored blue on the attached\nExhibit B of said BOE report:\n96th Street between Sepulveda Boulevard and Jetway\nBoulevard, Vicksburg Avenue between 98th Street and 96th\nStreet, and a portion of the easterly side of Sepulveda\nBoulevard from approximately 150-feet southerly of 96th Street\nto approximately 575-feet northerly thereof\n7. FIND that there is a public benefit to this Project. Upon vacation\nof the street, the City is relieved of its ongoing obligation to\nmaintain the street. In addition, the City is relieved of any\npotential liability that might result from continued ownership of\nthe involved street easements.\n8. FIND that, in conformance with Section 556 of the City Charter,\nthe vacation is in substantial conformance with the purposes,\nintent and provisions of the General Plan.\n9. FIND that, in conformance with Section 892 of the California\nStreets and Highways Code, the vacation area is not necessary\nfor non-motorized transportation facilities.\n10. FIND that, in conformance with Section 8324 of the California\nStreets and Highways Code, the vacation area is not necessary\nfor present or prospective public use.\n11. ADOPT said BOE report with the conditions contained therein.\n12. AUTHORIZE the BOE to issue a revocable permit to the\npetitioner of this vacation request, or its representative, subject\nto satisfaction of the conditions for issuing such permit, to close,\nfence, occupy, demolish, excavate, grade, and construct in the\npublic right-of-way of 96th Street between Sepulveda Boulevard\nand Jetway Boulevard, Vicksburg Avenue between 98th Street\nand 96th Street, and a Portion of the Easterly side of Sepulveda\nBoulevard from approximately 150-feet southerly of 96th Street\nto approximately 575-feet northerly thereof within the\nconditionally approved vacation area, prior to finalizing and\nrecording the street vacation of a portion of this street.\nFiscal Impact Statement: The City Engineer reports that the petitioner\nhas paid a fee of $47,080 for the investigation of this request pursuant\nto Section 7.42 of the Los Angeles Administrative Code (LAAC). Any\ndeficit fee to recover the cost pursuant to Section 7.44 of the LAAC\nwill be required of the petitioner. Maintenance of the public easement\nby City forces will be eliminated.
