(35)\n21-1188-S12\nBUDGET AND FINANCE COMMITTEE REPORT relative to a\nproposed amendment to Contract No. C-144882 with Kendall Brill &\nKelly, LLP to increase the contract ceiling for legal services related to\nthe July 11, 2021 sewage discharge incident at the Hyperion Water\nReclamation Plant.\nRecommendations for Council action, SUBJECT TO THE APPROVAL\nOF THE MAYOR:\n1. APPROVE an amendment to Contract No. C-144882 with\nKendall Brill & Kelly, LLP to increase the contract ceiling by\n$180,000 for a total contract amount of $982,631, to be paid\nfrom Bureau of Sanitation special funds.\n2. AUTHORIZE the City Attorney, or designee, to prepare\nController instructions for any necessary technical adjustments,\nsubject to the approval of the City Administrative Officer (CAO);\nand, AUTHORIZE the Controller to implement the instructions.\n[The City Council may recess to Closed Session, pursuant to\nGovernment Code Section 54956.9(d)(2) and (e)(2), to confer with\nits legal counsel to discuss the need for additional funding for\nrepresentation regarding exposure to litigation in the above-\nentitled matter.]\nFiscal Impact Statement: None submitted by the City Attorney.
