3.\nPUBLIC HEARING TO ADOPT ORDINANCE NO. O2M26-4860 APPROVING ZONING\nTEXT AMENDMENT AMD-26-03, AMENDING THE ALHAMBRA MUNICIPAL CODE TO\nUPDATE CHAPTER 23.15 (INCLUSIONARY HOUSING); ADOPT RESOLUTION NO.\nR2M26-8 UPDATING THE INCLUSIONARY HOUSING REGULATIONS AND\nINCLUSIONARY HOUSING IN-LIEU FEE SCHEDULE; AND DETERMINE THIS\nACTION IS EXEMPT FROM CEQA – F2M18-35, N2M26-34, R2M26-8, O2M26-4860\nThis is the time and place set by Notice No. N2M26-34 for the City Council to hold a public\nhearing to consider an ordinance approving a Zoning Text Amendment to amend Title 23\n(Zoning) of the Alhambra Municipal Code to update Chapter 23.15 (Inclusionary Housing)\nconsistent with the objectives of the City’s adopted 2021-2029 Housing Element. Zoning\nText Amendment AMD-26-03 is a City-initiated update to the City’s Inclusionary Housing\nOrdinance (IHO). Based on the proposed updates to the IHO, updates are also required\nto the Inclusionary Housing Regulations and Inclusionary Housing In-Lieu Fee schedule.\nThe proposed updates were informed by implementation of the IHO over the past five (5)\nyears and are intended to improve clarity as well as align with state housing law-\nspecifically, State Density Bonus Law. The proposed amendments maintain the City’s\n15% inclusionary unit requirement while revising affordability level requirements and\nsimplifying compliance mechanisms. Updates to the Inclusionary Housing Regulations\nand Inclusionary Housing In-Lieu Fee schedule will ensure consistency with the proposed\nIHO updates. Adoption of these proposed updates aligns with the goals, policies, and\nobjectives set forth in the City’s 2021-2029 Housing Element. Any fees collected under\nthe proposed updated Inclusionary Housing In-Lieu Fee Schedule shall be deposited into\nthe City’s Inclusionary Housing Trust Fund pursuant to the provisions of the proposed\nInclusionary Housing Ordinance and proposed Inclusionary Housing Regulations.\nThe City reviewed the environmental impacts of this Ordinance under the California\nEnvironmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the\nregulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). This Ordinance is not subject to further review environmental review\nbecause: (1) it will not result in a direct or reasonably foreseeable indirect physical change\nin the environment (14 Cal. Code Regs. § 15060(c)(2)); (2) there is no possibility that this\nOrdinance will have a significant effect on the environment (14 Cal. Code Regs. §\n15061(b)(3)); and (3) the Ordinance, by itself, does not constitute a “project” as defined in\nsection 21065 of the Public Resources Code and the CEQA Guidelines (14 Cal. Code\nRegs. § 15378). It can be seen with certainty that there is no possibility that this Ordinance\nmay have a significant effect on the environment.\nRecommended Action:\nCity Council:\n1.\nConduct a Public Hearing to receive public testimony;\n2.\nDetermine which of the Planning Commission’s recommendations to include and\ndirect the City Attorney to introduce and give first reading by title only, waiving\nfurther reading to the following ordinance entitled:\nOrdinance No. O2M26-4860: An Ordinance of the City Council of the City of\nAlhambra, California adopting Zoning Text Amendment AMD-26-03, amending the\nAlhambra Municipal Code to update Chapter 23.15 (Inclusionary Housing)\nwhich ordinance shall return for a second reading and adoption at the next City\nCouncil meeting on April 27, 2026;\n3.\nAdopt the following Resolution entitled: Resolution No. R2M26-8: A Resolution of\nthe City Council of the City of Alhambra, California adopting updated Inclusionary\nHousing Regulations and an updated Inclusionary Housing In-Lieu Fee Schedule;\nand,
