9I.\nAPPROVAL OF AMENDED AND RESTATED NATIONAL POLLUTANT DISCHARGE\nELIMINATION SYSTEM (NPDES) STORMWATER PERMIT IMPLEMENTATION\nAGREEMENT\nThe original National Pollutant Discharge Elimination System (NPDES) Stormwater\nPermit Implementation Agreement (D90-094), which was executed in 1990 and amended\nin 1993 and 2002 (D02-048), established a cooperative framework for implementing the\nOrange County Stormwater Program. While the current Agreement has achieved many\nsignificant water quality improvements to local beaches and inland waters, state\nregulatory requirements issued through the MS4 permits have changed significantly since\nthe Agreement was last updated. The proposed Agreement restates and updates the\noriginal Agreement to reflect current regulatory requirements, administrative practices,\nand programmatic needs. Staff recommends approval of the amended and restated\nNPDES Stormwater Permit Implementation Agreement.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to the California Environmental Quality\nAct (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment); and\n2. Approve the Amended and Restated National Pollutant Discharge Elimination System\n(NPDES) Stormwater Permit Implementation Agreement (“Agreement”) between the\nCounty of Orange, Orange County Flood Control District (District), and participating\nOrange County cities (collectively called Permittees); and\n3. Authorize the City Manager to execute the Agreement and any related documents\nnecessary to implement the terms of the Agreement.
