17. RESOLUTION DECLARING CITY’S INTENTION TO DISPOSE OF REAL PROPERTY\nAND SETTING THE DATE FOR A PUBLIC HEARING TO CONSIDER THE\nDISPOSITION OF PROPERTY ADJACENT TO STORY PARK – F2M21-22, R2M23-23\nIn January 2021, the City received a complaint from a neighbor regarding leaves falling\nfrom an oak tree from a vacant, adjacent property creating a hazard on Story Place. Staff\ninvestigated the matter and determined the property in question was part of Story Park.\nThe investigation also revealed the land was landlocked and only accessible through the\nsix adjacent residential properties. Given the location and status of this landlocked,\nunimproved and publicly inaccessible property, staff believes the property is more properly\nreconfigured to be part of the adjacent residential properties. This will eliminate\nmaintenance and liability issues for the City. In April 2022, the City Council directed staff\nto move forward to dispose of the property. Pursuant to California Government Code\n§38503, before the disposition of such property, the City Council is required to adopt a\nResolution of Intention describing the proposed abandonment of property and to fix a time,\n8\n4-24-23\nat least thirty days after adoption of the Resolution of Intention, when it will consider and\ntake action to order all or any portion of the park abandoned and the land sold or otherwise\ntransferred. This public hearing is scheduled for June 26, 2023. The Lot Line Adjustment,\nGeneral Plan Amendment, and Zone Change applications, along with a Resolution\ndeclaring the Property to be exempt surplus under provisions of California Government\nCode §54220, et seq. (the “Surplus Land Act”), will also be presented to the City Council\non that date.\nRecommended Action: City Council adopt Resolution No. R2M23-23 entitled: A\nResolution of the City Council of the City of Alhambra, California, declaring its intention to\ndispose of real property and setting the date for a meeting to consider the disposition of\nproperty declaring the City’s intention to dispose of the unimproved real property\napproximately 12,937 square feet in size that is part of Story Park (APN 5337-002-900)\nbut is separated from the improved portion of Story Park by a concrete channel known as\nthe San Pascual Wash, and set a Public Hearing date of June 26, 2023 at 6:00 p.m., or\nas soon thereafter as the matter may be heard, to consider and take action to order that\nlandlocked, inaccessible and unimproved portion of the park abandoned and the land\ntransferred.
