8.c.\nCONSIDERATION OF ORDINANCE NO. 1293 TO CONSIDER A ZONE\nTEXT AMENDMENT (NO. 26-01), TO AMEND CHAPTER 17.12\n“ACCESSORY\nDWELLING\nUNITS”,\nTO\nCOMPLY\nWITH\nNEW\nREQUIREMENTS SET FORTH BY THE STATE OF CALIFORNIA.\nThe proposed ordinance will amend Chapter 17.12 of the South El Monte\nMunicipal Code to comply with recent changes to state law that impose new\nlimits on local authority to regulate Accessory Dwelling Units (ADUs) and\nJunior Accessory Dwelling Units (JADUs). Except as otherwise noted in this\nstaff report, these new laws became effective January 1, 2026. The\nPlanning Commission, at its regular meeting on March 24, 2026,\nrecommended City Council approval of the proposed ordinance.\nRECOMMENDED ACTION: Staff recommends that the City Council:\n1. Conduct a public hearing;\n2. Take public testimony; and\n3. Waive full reading and introduce Ordinance No. 1293, approving Zone\nText Amendment (No. 26-01) to amend and replace South El Monte\nMunicipal Code (“SEMMC”) Chapter 17.12 “Accessory Dwelling Units”\nto bring the SEMMC into conformity with the newly amended State law.
