12.b. COUNCILMEMBER MANUEL ACOSTA\n1. CONTINUED FROM THE APRIL 21, 2026, REGULAR CITY COUNCIL\nMEETING: Referendum on South El Monte Measure CM\nDiscussion/Action: South El Monte Measure CM was on the ballot in\nNovember 2022, allowing up to three marijuana (cannabis) retail\nbusinesses. The measure received 1,336 YES votes (53.6%) and 1,156\nNO votes (46.4%). Soon after, the city council approved a 1,000 foot\nbuffer zone to protect our most vulnerable residents. The 1,000 foot\nbuffer zone allowed four (4)potential locations for marijuana (cannabis)\nbusinesses to operate in the city of South El Monte. Since then, and after\nmuch discussion, the majority of the city council approved a jurisdictional\nboundary of 350 feet, which increased the number of potential marijuana\n(cannabis) locations in South El Monte to one-hundred four (104).\nIt is apparent, from the hundreds of comments given during the Public\nComment session of the city council meetings from residents and\nconcerned citizens over the last year, the topic of marijuana dispensaries\nand related businesses in South El Monte is of high interest and concern.\nTherefore, the council should consider the concerns wishes of it’s South\nEl Monte residents and place a ballot initiative to repeal and revoke\nMeasure CM in November’s 2026 election.\n\n2. City Manager’s Decision to Approve Unscheduled, Unapproved Projects\nDiscussion/Action: The city council approved a construction contract for\nthe FY25-26 Pavement Rehabilitation Project (City Project No. 644) on\nSeptember 2, 2025. The contract and the Construction Notice, issued on\nNovember 24, 2025, identifies those specific streets, including the date\nand time they were to be repaved. The re-pavement project was\nscheduled and completed between December 1 thru December 9, 2025.\nAllgeyer Street was not on the schedule, however, it was re-paved on\nDecember 9, 2025. The re-pavement of Allgeyer Street was approved by\nthe city manager, and paid for with the construction contingency budget.\nSince Allgeyer street was not in the scope of the contractual budget or\nthe Construction Notice, how was the decision made to solely re-pave\nAllgeyer Street, and not any other streets in dire need of re-paving and\nin the surrounding area?

Except as otherwise noted in this\nstaff report, these new laws became effective January 1, 2026. In addition to existing incentives, staff proposes\na pilot program seeded with $50,000 transferred from the General Fund\nbalance reserves and managed internally based on effectiveness for paint\nreimbursement, mural lighting, and/or an artist stipend in addition to sign\npermit fee waivers, artist business license fee waivers, and free rental of\nthe City's scissor lift and time-lapse video equipment.\nRECOMMENDED ACTION: Staff recommends City Council discuss and\napprove the Business Mural Incentive Program seeded with $50,000\ntransferred from the General Fund balance reserves.

9.b.\nCONSIDERATION\nOF\nRESOLUTION\nNO.\n26-033,\nAPPROVING\nAGREEMENT WITH DAWSON & ASSOCIATES FOR CONSULTING\nSERVICES FOR INTERGOVERNMENTAL COORDINATION (IGC)\nA consultant is needed to provide professional intergovernmental\ncoordination services to effectively communicate municipal opportunities\nand strengthen partnerships with Federal and Los Angeles County\nrepresentatives affiliated with Whittier Narrows in the County of Los\nAngeles. Dawson & Associates is familiar with such coordination through\nthe recent Magellan Industrial/Recreation project at 825 Lexington Gallatin\nRoad. The firm possesses a unique history and technical expertise\nregarding South El Monte's specific needs. Staff recommends entering into\na professional services agreement to ensure the City follows appropriate\nstrategy, procedures, and communication with Federal agencies to\nunderstand land use opportunities within Whittier Narrows.\nRECOMMENDED ACTION: Staff recommends City Council adopt\nResolution No. 26-033, approving a professional services agreement with\nDawson & Associates for Intergovernmental Coordination Services in an\namount not to exceed $117,000 for an initial term of one hundred and eighty\n(180) days.\nGENERAL BUSINESS (CONTINUED)

9.c.\nCONSIDERATION\nAND\nAPPROVAL\nOF\nRESOLUTION\n26-034,\nAPPROVING THE SECOND AMENDMENT TO THE CITY MANAGER\nEMPLOYMENT AGREEMENT WITH RENE SALAS\nStaff is recommending the City Council to approve the Second Amendment\nto the City Manager Employment Agreement with Rene Salas.\nRECOMMENDED ACTION: Staff recommends City Council adopt\nResolution 26-034, approving the Second Amendment to the City Manager\nEmployment Agreement with Rene Salas and authorize the Mayor to\nexecute the City Manager Employment Agreement. In the alternative, Staff\nrecommends City Council provide additional direction regarding the\nattached City Manager Employment Agreement.

9.d.\nSOUTH EL MONTE COMMUNITY FOUNDATION UPDATE AND\nCONSIDERATION TO OPEN THE APPLICATION PERIOD FOR\nAPPOINTMENTS TO THE BOARD OF DIRECTORS\nStaff is providing an update on the formation status of the South El Monte\nCommunity Foundation and seeking City Council direction to open a three-\nweek application period for the Foundation’s Board of Directors, after which\nstaff will return to Council with all qualified applications for consideration\nand appointment.\nRECOMMENDED ACTION:\nStaff recommends the City Council:\n1. Provide staff direction to open the application period for the South El\nMonte Community Foundation Board of Directors for a period of three (3)\nweeks, after which staff will return to the City Council with all qualified\napplications received for consideration and appointment; and\n2. Receive and file this report regarding updates on the formation status of\nthe South El Monte Community Foundation.
