A. ORDINANCES NO. 728 AND NO. 729 AMENDING TO UPDATE THE SAN\nGABRIEL MUNICIPAL CODE RELATING TO NEW STATE LAW FOR URBAN\nDWELLING UNITS (ZTA25-001), ACCESSORY DWELLING UNITS AND\nJUNIOR ACCESSORY DWELLING UNITS (ZTA26-001) – INTRODUCTION\nAND FIRST READING\nThe California Legislature adopted Senate Bills 450, 544, and 1211 and\nAssembly Bills 130, 462, and 1154 in 2024 and 2025, amending existing State\nlaw pertaining to Urban Dwelling Units, Accessory Dwelling Units, and Junior\nAccessory Dwelling Units. Draft ordinances were provided to the Planning\nCommission for consideration and recommendation on July 14, 2025 and\nFebruary\n9,\n2026.\nFollowing\ndiscussion,\nthe\nPlanning\nCommission\nrecommended approval to the City Council of the proposed Zone Text\nAmendments (ZTA25-001 and ZTA26-001) for Ordinances No. 728 and No. 729.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendments were reviewed for compliance with the California Environmental\nQuality Act (CEQA). Pursuant to Section 15061(b)(3) of the CEQA Guidelines, the\namendment to a Zoning Ordinance is not considered a project as defined in\nSection 15378 and can be seen with certainty that it will not have a significant\neffect on the environment. The proposed amendment to the Zoning Ordinance\nqualifies for this CEQA exemption as there is no possibility that the ordinance will\nhave a significant effect on the environment as it amends the City’s Municipal\nCode to demonstrate compliance with State Accessory Dwelling Units Law.\nRecommended Action:\nStaff recommends that the City Council:\n1. Conduct the public hearing and discuss the proposed Ordinances No. 728\nand No. 729.\n2. Waive full reading and introduce Ordinances No. 728 and No. 729 by title\nonly:\nAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL,\nCALIFORNIA, AMENDING CHAPTER 153 (ZONING CODE) OF THE SAN\nGABRIEL MUNICIPAL CODE RELATING TO HOUSING DEVELOPMENT IN\nRESIDENTIAL ZONES\nand\nAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL,\nCALIFORNIA, AMENDING CHAPTER 153 (ZONING CODE) OF THE SAN\nGABRIEL MUNICIPAL CODE RELATING TO ACCESSORY DWELLING\nUNITS AND JUNIOR ACCESSORY DWELLING UNITS\n3. Waive future reading of the Ordinances and schedule the second reading\nand adoption of the Ordinances for the next regular City Council meeting.\nThe Ordinances would then become effective 30 days after the adoption.\nALTERNATIVE OPTION FOR CONSIDERATION\nProvide comments and direct staff to return at a later date with revisions to\nthe amendments for the City Council’s review and approval.
