Environmental Considerations:\nThe action being considered by the City Council is exempt from the California\nEnvironmental Quality Act (CEQA) pursuant to Section 15301- Class 1 of the\nCEQA Guidelines, which exempts the replacement or reconstruction of\nexisting utility systems and/or facilities involving negligible or no expansion.\nContact Person: Principal Engineer Alex\nRecommended Action: 1) Adopt Resolution No. 2026-39, titled, "A\nResolution of the City Council of the City of Encinitas, California, Amending the\nFiscal Year 2025-26 Budget"; and 2) Authorize the City Manager, or designee,\nto execute a contract in substantial form and any necessary amendments and\ntime extensions, in consultation with the City Attorney, with Whillock\nContracting, Inc. in an amount of $1,123,171 plus a fifteen percent (15%)\ncontingency of $168,475, and $210,000 for on call inspection, biological\nmonitoring, and material testing for a total project not-to-exceed amount of\n$1,501,646\nfor\nthe\nconstruction\nof\nthe\nCottonwood\nCreek\nSewer\nImprovements project (CE26E).\n2026-05-20 Item 08D Sewer Award Construction Contract for Cottonwood\nCreek
