10B. Public hearing and consideration of Resolution No. 2026-34 adopting a\nCitywide Development Impact Fee Nexus Study, amending the City’s\nschedule of Development Impact Fees and adopting a Capital Improvement\nPlan as part of the Nexus Study. Environmental Considerations: The action\nbeing considered by the City Council is exempt from the California\nEnvironmental Quality Act (CEQA) because it is not a "project" under Section\n15061(b)(3) of the CEQA Guidelines because it can be seen with certainty\nthat there is no possibility that the activity in question may have a significant\neffect on the environment. The action is also exempt from CEQA under\nSection 15378(b)(5) of the CEQA Guidelines because it involves an\norganizational or administrative activity of government that will not result in the\ndirect or indirect physical change in the environment. Approval of the Citywide\nDevelopment Impact Fee Nexus Study dated May 2026, Capital Improvement\nPlan associated with the Nexus Study, and adoption of the development\nimpact fees does not have the potential for causing a significant effect on the\nenvironment. In addition, the adoption of this Resolution approves and sets\nforth a procedure for determining fees for the purpose of obtaining funds for\ncapital projects and equipment necessary to maintain service within existing\nservice areas and is statutorily exempt from CEQA pursuant to State CEQA\nGuidelines 15273(a)(4). Also, approval of the Capital Improvement Plan\nassociated with the Nexus Study, is exempt from the requirements of CEQA\npursuant to State CEQA Guidelines Section 15378(b)(4) because the Plan is\nnot a "project" as defined by CEQA, but involves the creation of government\nfunding mechanisms or other government fiscal activities that do not involve\nany commitment to any specific project that may result in a potentially\nsignificant physical impact on the environment.
