C. CONDUCT A PUBLIC HEARING AND ADOPTION OF RESOLUTION NO. 26-\n23 VACATING AN UNUSED SIDEWALK AREA ALONG THE FRONTAGE OF\n261 SOUTH MISSION DRIVE AND RESERVING A PARKWAY DRAIN\nEASEMENT\nParcel A is a section of unused sidewalk-area within the right-of-way easement\nalong the frontage of the property at 261 South Mission Drive, which currently\noperates as a karaoke lounge. On May 5, 2026, based on staff’s\nrecommendation and as required by the California Streets and Highways Code,\nCity Council adopted Resolution No. 26-11 declaring the City’s intention to\nvacate Parcel A while reserving a parkway drain easement, fixing the time and\nplace for a public hearing at the City Council meeting on June 2, 2026 for all\npersons interested in or objecting the proposed vacation, and directing staff to\npublish and post notices. After hearing and considering all the evidence offered\nby any interested persons at the hearing, if City Council finds that Parcel A is\nunnecessary for present or prospective public use, the City Council may adopt\na resolution vacating it.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council:\n1. Conduct a Public Hearing and consider all public comments regarding this\nmatter; and\n2. Adopt Resolution No. 26-23 vacating an unused sidewalk area along the\nfrontage of 261 South Mission Drive, subject to the reservation of a parkway\ndrain easement to preserve the City’s right to access, maintain, repair,\nreplace, and operate the City-owned drainage facility located within the\nvacated area.
