C. RESOLUTION NO. 26-19 AUTHORIZING THE EXCEPTION OF THE 180-DAY\nWAITING PERIOD TO APPOINT CALIFORNIA PUBLIC EMPLOYEES’\nRETIREMENT SYSTEM (CALPERS) RETIREE RUBEN SORIANO TO INTERIM\nPOLICE CAPTAIN IN ACCORDANCE WITH GOVERNMENT CODE SECTION\n7522.56 AND SECTION 21221(H)\nSince August 2025, the Police Department has experienced vacancies at the\nPolice Lieutenant and Police Captain positions due to retirements and other\nunexpected personnel matters. The department has since filled the Police\nLieutenant vacancy, but the Police Captain position remains vacant pending the\ncompletion of an open-competitive recruitment. Police Captain is a critical\nposition within the Police Department. The department maintains two Police\nCaptain positions due to its size and scope of operations. The Police Captain\nreports directly to the Police Chief and oversees major divisions of the\ndepartment. The position also serves as the department head and\nrepresentative in the Police Chief’s absence. Ruben Soriano is a CalPERs retiree\nfrom the Alhambra Police Department and retired as a Police Lieutenant in\nDecember 2025 after serving the department for more than 28 years. Due to\nhis extensive experience with local law enforcement, Mr. Soriano was identified\nas someone who could help the department during this transitional period for\nits leadership team.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 26-19, which\nprovides an exception of the 180-day waiting period for CalPERS retirees and\nauthorizes the City Manager to appoint CalPERS retiree, Ruben Soriano, to\nInterim Police Captain while a recruitment to fill the position on a permanent\nbasis is completed.
