1. CONSIDERATION OF AN APPEAL OF THE PLANNING COMMISSION’S\nDECISION TO DENY DESIGN REVIEW CASE NO. DR 22-26 AT 535\nOLD MILL ROAD TO THE DEMOLISH AN EXISTING 1,751 SQUARE-\nFOOT RESIDENCE AND CONSTRUCT A NEW TWO-STORY 2,690\nSQUARE-FOOT RESIDENCE WITH A DETACHED TWO-CAR GARAGE\n(CHAN)\nRecommendation: Based on the information submitted to the record, staff\nrecommends that the City Council: (1) determine that based on the whole of the\nadministrative record, that the proposed addition is exempt from CEQA pursuant to\nState CEQA Guidelines, Article 19, Section 15301, Class 1 & Class 3, and that there is\nno substantial evidence demonstrating an exception to the categorical exemption\npursuant to CEQA Guidelines Section 15300.2 applies; (2) find that the proposed\nproject meets the required findings; and (3) approve the project. If the City Council\nconcurs with staff’s recommendation, an appropriate motion would be:\n“I move to adopt City Council Resolution No. R-26-21 approving the project as\npresented and find that the proposed project meets the required findings and\ndetermine that based on the whole of the administrative record, that the proposed\naddition is exempt from CEQA pursuant to State CEQA Guidelines, Article 19, Section\n15301, Class 1 & Class 3, and that there is no substantial evidence demonstrating an\nexception to the categorical exemption pursuant to CEQA Guidelines Section 15300.2\napplies.”\nIf the City Council affirms the adoption of Planning Commission Resolution No. PCR\n26-17, the appropriate motion would be:\n“I move to adopt City Council Resolution No. R-26-21 affirming the adoption of\nPlanning Commission Resolution No. PCR 26-17 to deny Design Review Case Number\nDR-22-26 at 535 Old Mill Road to demolish an existing 1,751 sq ft single-family\nresidence and construct a 2,690 sq ft two-story residence with a detached 2-car\ngarage.”\nNEW BUSINESS
