CONSIDERATION OF RESOLUTION NO. 26-123, AUTHORIZING THE\nEXEMPTION TO THE FORMAL SOLICITATION PROCESS, AWARDING A\nCONTRACT THROUGH A COOPERATIVE PURCHASING PROCESS FOR\nUTILITY COST RECOVERY AND REDUCTION SERVICES\nPotential Action(s)\nIf the City Council concurs with the information provided within this\nAdministrative Report, the appropriate action would be to adopt Resolution\nNo. 26-123, which will:\n1. Authorize an exemption to the formal solicitation process under Section\nXI.A.1.4 of City Policy 201-2-1.\n2. Award a Professional Services Agreement to Procure America, LLC for\nutility cost recovery and reduction services, utilizing a cooperative\npurchasing process based on the competitively solicited County of Orange\nContract No. RCA-017-1910018 and pricing and services substantially\nsimilar thereto, for a 60-month savings term with compensation not to\nexceed 30% of actual verified savings.\n3. Approve, and authorize the City Manager to execute, Contract no. C26-\n46, by and between the City of San Clemente and Procure America, LLC.,\nproviding for utility cost recovery and reduction services, in a form\nsubstantially similar to Attachment 2 of the Administrative Report dated\nJune 16, 2026.
