10A. BID PROTEST HEARING AND CONSIDERATION OF A RESOLUTION\nAWARDING A CONSTRUCTION CONTRACT FOR THE PROJECT TO UNION\nPAVEMENT SERVICES, INC. IN AN AMOUNT NOT TO EXCEED $956,951,\nAUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION\nCONTRACT, AND FINDING THE PROJECT CATEGORICALLY EXEMPT\nFROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nPotential Action(s)\nIf the City Council concurs with the contents of the Administrative Report,\nappropriate actions include:\n1. Conduct a bid protest hearing, open the hearing, hear public testimony\nand comments, including any evidence and argument presented by the\nbidders, and close the hearing.\nAND, after the protest hearing, adopt Resolution No. 26-113 (Attachment 1),\nwhich will:\n2. Find the FY 2026 Street Rehabilitation Program, CIP Project No. 16325,\ncategorically exempt from the California Environmental Quality Act\n(CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the\nCalifornia Environmental Quality Act Guidelines.\n3. Insist on strict compliance with the bid specifications, disqualify the\napparent first and second low bidders, All American Asphalt and\nPavement Coatings, Co., respectively, as nonresponsive and grant the bid\nprotest submitted by Union Pavement Services, Inc.\n4. Award the FY 2026 Street Rehabilitation Program, CIP Project No. 16325,\nconstruction contract to Union Pavement Services, Inc.\n5. Approve, and authorize the City Manager to execute, Contract No. C26-\n42, by and between the City of San Clemente and Union Pavement\nServices, Inc., providing for FY 2026 Street Rehabilitation Program, in an\namount not to exceed $956,951.
