24. CONSIDERATION OF ADOPTION OF RESOLUTION NO. 8016 DETERMINING THAT\nTHE PUBLIC INTEREST AND NECESSITY DEMAND THE RECONSTRUCTION,\nREHABILITATION OR REPLACEMENT OF MUNICIPAL IMPROVEMENT PROJECTS\nOF THE CITY AND THEIR FINANCING THROUGH THE ISSUANCE OF GENERAL\nOBLIGATION BONDS IN AN AMOUNT NOT TO EXCEED $80,000,000; FIRST\nREADING AND INTRODUCTION OF ORDINANCE NO. 2416, AN ORDINANCE OF\nTHE CITY OF SOUTH PASADENA ORDERING THE SUBMISSION OF A\nPROPOSITION INCURRING BONDED INDEBTEDNESS TO THE QUALIFIED VOTERS\nOF THE CITY OF SOUTH PASADENA AT THE GENERAL MUNICIPAL ELECTION TO\nBE HELD ON NOVEMBER 3, 2026, FOR THE PURPOSE OF FINANCING THE COSTS\nOF THE AQUISITION, CONSTRUCTION, COMPLETION, IMPROVEMENT,\nRECONSTRUCTION, REHABILIATION OR REPLACEMENT OF CERTAIN\nMUNICIPAL IMPROVEMENTS PROJECTS OF THE CITY; AND FIND THAT THE\nPROPOSED ACTION AND PROPOSED BALLOT MEASURE ARE NOT SUBJECT TO\nTHE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nRecommendation\nIt is recommended that the City Council:\n1. Receive and file this report, and provide direction to staff regarding a potential\n7\ngeneral obligation (G.O.) bond measure for street, roadway, sidewalk, and related\ninfrastructure improvements;\n2. Find that the proposed action and the proposed ballot measure are not subject to\nthe California Environmental Quality Act (California Public Resources Code Section\n21000 et seq.) (“CEQA”) pursuant to Section 15060(c)(2) (the activities will not result\nin a direct or reasonably foreseeable indirect physical change in the environment)\nand 15060(c)(3) (the activities are not a project as defined in Section 15378) of the\nCEQA Guidelines, California Code Regulations, Title 14, Chapter 3. State CEQA\nGuideline Section 15378(b)(4) excludes “government funding mechanisms or other\ngovernment fiscal activities” from its definition of “project” when they “do not involve\nany commitment to any specific project which may result in a potentially significant\nphysical impact on the environment.” On its own, voter approval of the proposed\nbonds will not “commit” the City to issue bonds or construct the Project;\n3. Adopt, by a two-thirds (2/3) vote of all members of the City Council, Resolution No.\n8016 determining that the public interest and necessity demand the acquisition,\nconstruction, improvement, reconstruction, rehabilitation, or replacement of\nmunicipal improvement projects of the City and their financing through the issuance\nof general obligation bonds; and\n4. Waive full reading of Ordinance No. 2416 and introduce by title only an Ordinance\nof the City ordering the submission of a proposition to incur bonded indebtedness in\nan amount not to exceed $80,000,000 for the certain municipal improvement\nprojects to the qualified voters at the November 3, 2026, General Municipal\nElection.
