26. PROPOSITION 218 PUBLIC HEARING TO CONSIDER DOWNLOAD\nPROPOSED MAXIMUM SOLID WASTE AND\nRECYCLING COLLECTION SERVICE RATES AND\nAPPROVAL OF FOURTH AMENDMENT TO FRANCHISE\nAGREEMENT NO. 23-132 WITH CR&R\nINCORPORATED\nRecommendations:\n1. Conduct a Proposition 218 public hearing regarding the\nproposed maximum solid waste and recycling collection\nservice rates and receive the City Clerk’s final tabulation\nof written protests;\n2. Determine whether a majority protest exists under Article\nXIIID, Section 6 of the California Constitution;\n3. If a majority protest does not exist, adopt the Resolution\ntitled, “A RESOLUTION OF THE CITY COUNCIL OF\nSETTING MAXIMUM SOLID WASTE SERVICE\nRATES, APPROVING THE FOURTH AMENDMENT\nTO AGREEMENT NO. 23-132 WITH CR&R\nINCORPORATED, AND REPEALING RESOLUTIONS\nINCONSISTENT HEREWITH”;\n4. Approve the Fourth Amendment to Agreement No. 23-\n132 with CR&R Incorporated and authorize the City\nManager to execute the amendment in substantially the\nform attached, subject to minor revisions approved by the\nCity Attorney; and\n5. Find the proposed action exempt under the California\nEnvironmental Quality Act (CEQA) pursuant to CEQA\nGuidelines sections 15061 (B)(3) and 15308 or,\nalternatively, determine that the proposed action is not a\n“project” under CEQA pursuant to CEQA Guidelines\nsection 15378.
