Lake Forest
City Council
Agenda Item 19
19. DECLARATION OF THE WHISPERING HILLS SITE AS SURPLUS LAND
AND AUTHORIZATION FOR STAFF TO ISSUE A NOTICE OF
AVAILABILITY PURSUANT TO THE CALIFORNIA SURPLUS LAND ACT
RECOMMENDED ACTION: 1. Adopt a Resolution entitled: “A
MAKING FINDINGS AND DECLARING, PURSUANT TO GOVERNMENT
CODE SECTION 54221, THAT CERTAIN REAL PROPERTY LOCATED
ALONG LAKE FOREST DR, BETWEEN VINTAGE WOODS ROAD AND
DIMENSION DRIVE, IDENTIFIED WITH ASSESSOR’S PARCEL NUMBER
613-621-18, IS SURPLUS LAND, APPROVING THE NOTICE OF
AVAILABILITY THEREFOR, AUTHORIZING THE CITY MANAGER TO
COMPLY WITH THE SURPLUS LAND ACT AND TAKING RELATED
ACTIONS, FINDING THAT SUCH DECLARATION IS EXEMPT FROM
ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT PURSUANT TO SECTIONS 15060(C)
(3) AND 15312 OF THE STATE CEQA GUIDELINES AND DIRECTING
STAFF TO ISSUE A NOTICE OF EXEMPTION” 2. Authorize staff to issue a
Notice of Availability (“NOA”) to the California Department of Housing and
Community Development (“HCD”) and all entities required under the
Surplus Land Act (Government Code §54220 et seq.). 3. Find, pursuant to
the California Environmental Quality Act (“CEQA"), that declaring the
property as surplus land, approving the form of the Notice of Availability,
and authorizing the City Manager to comply with the Surplus Land Act, will
not result in a direct or reasonably foreseeable indirect physical change in
the environment and therefore is not subject to CEQA pursuant to CEQA
Guidelines Section 15060(c)(3). Alternatively, find that the action is exempt
from CEQA pursuant to CEQA Guidelines Section 15312 (Surplus
Government Property), because the property is not located in an area of
statewide, regional, or area-wide concern. Direct staff to file a Notice of
Exemption.
