20. CONTRACT AMENDMENT: PROFESSIONAL ON-CALL CEQA & NEPA\nCONSULTING SERVICES – F2M16-39, C2M16-42, M2M23-86\nOn June 27, 2016, the City Council awarded a Professional Services Agreement\n(“Agreement”) to Dudek for California Environmental Quality Act (CEQA)/National\nEnvironmental Policy Act (NEPA) consulting services on an as-needed basis for future\ndevelopment projects. This contract provides for a revolving fund to render services that\nare reimbursed by a project applicant. Previously, the City Council approved amendments\nto the Agreement in 2018 and in 2021 (both to adjust the not-to-exceed cap). The City has\nengaged Dudek with a variety of projects in the past and will need on-call CEQA services\nfor future development projects. The proposed amendment extends the term for an\nadditional five-years through June 27, 2027 after which time, any additional renewal terms\nwill require City Council approval. The contract can be terminated at any time by providing\nsixty days advance notice. The amendment also increases the not-to-exceed cap by\n$250,000 (from $350,000 to $600,000 for the life of the contract), unless the Agreement\nis further amended.\nRecommended Action: City Council approve that certain Third Amendment to\nAgreement for Professional Planning Services with Dudek for on-call California\nEnvironmental Quality Act (CEQA) and National Environmental Policy Act (NEPA)\nconsulting services on an as-needed basis for future development projects, on file in the\nCity Clerk’s Office as C2M16-42 and by this reference incorporated herein and made a\npart of as though fully set forth herein; and, direct staff to undertake the necessary steps\nto finalize the Council’s action.
