4-D. A CONTINUED PUBLIC HEARING TO CONSIDER INTRODUCTION AND FIRST READING\nOF ZONING CODE AMENDMENT NO. 22-01 (ZCA-22-01), AN ORDINANCE ADDING THE\nMONTEREY PARK MUNICIPAL CODE, CHAPTER 21.19, ENTITLED “INCLUSIONARY\nHOUSING” TO IMPLEMENT THE MONTEREY PARK HOUSING ELEMENT.\nIt is recommended that the City Council consider:\n(1) Opening a continued public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing to introduce and waive first reading of Ordinance No. _____ adding Chapter 21.19\n(Inclusionary Housing) to the Monterey Park Municipal Code to implement the Monterey\nPark Housing Element; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nPursuant to the California Environmental Quality Act (Public Resources Code § 21000, et seq.;\n“CEQA”) and its implementing regulations (14 Cal. Code of Regs. § 15000, et seq.; the "CEQA\nGuidelines”), the proposed Ordinance and Resolution (ZCA 22-01) are exempt from further\nCEQA review for the following reasons: (1) they will not result in a direct or reasonably\nforeseeable indirect physical change in the environment (CEQA Guidelines § 15060(c)(2)); (2)\nthere is no possibility that the Ordinance may have a significant effect on the environment\nbecause any potential, future, housing projects would undergo separate environmental review\n(CEQA Guidelines § 15061(b)(3)); and (3) the Ordinance and Resolution, by themselves, do not\nconstitute a “project” as defined in the CEQA Guidelines because they involve a policy action\nthat is legislative implementing affordable housing policy and affects prospective future housing\ndevelopment to comply with Housing Element Program 15 (CEQA Guidelines § 15378).\nPage 6 of 410\nMonterey Park City Council Agenda, June 7, 2023 - Page 7
