AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES\nAGREEMENT WITH THE NATELSON GROUP CONSULTING FIRM TO ASSIST THE CITY\nIN UPDATING ITS 2010 ECONOMIC DEVELOPMENT STRATEGIC PLAN AND TO CARRY\nOVER ARPA FUNDS OF $81,620 FROM FY2022-23 TO FY2023-24 TO FUND THE PROJECT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to enter into a professional services agreement, in the\namount of $81,620, with The Natelson Dale Group, Inc., in a form approved by the City\nAttorney, to assist the City in updating its 2010 Economic Development Strategic Plan;\nand\n(2) Taking such additional, related, action that may be desirable.

EDISON TRAILS PARK PLAYGROUND REPLACEMENT PROJECT – AWARD OF\nCONTRACT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a public works contract, in a form approved by\nthe City Attorney, with R.E. Schultz Construction, Inc in the amount of $207,272 for Edison\nTrails Park Playground Replacement Project, Specification No. 2023-003;\n(2) Authorizing the Director of Public Works to approve change orders and contingency up to\n$20,727 or 10% of the contract amount;\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe proposed project is categorically exempt from the requirements of the California\nEnvironmental Quality Act (CEQA) pursuant to 14 California Code of Regulations § 15301 as a\nClass 1 categorical exemption (Existing Facilities). The Project results in minor alterations to\nexisting public facilities involving no significant expansion of the existing use. The Project is not\nanticipated to have any significant impacts with regard to traffic, noise, air quality, or water\nquality.

CIP 96039 SIDEWALK REPAIR PROJECT– AWARD OF CONTRACT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a public works contract, in a form approved by\nthe City Attorney, with CT&T Concrete Paving, Inc., in the amount of $1,571,233 for the\nCapital Improvement Project (CIP) No. 96039 Sidewalk Repair Project, Specification No.\n2022-011.\n(2) Authorizing the Director of Public Works to approve change orders and contingency up to\n$157,123 or 10% of the contract amount;\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe proposed project is categorically exempt from the requirements of the California\nEnvironmental Quality Act (CEQA) pursuant to 14 California Code of Regulations § 15301 as a\nClass 1 categorical exemption (Existing Facilities). The Project results in minor alterations to\nexisting public facilities involving no significant expansion of the existing use. The Project is not\nanticipated to have any significant impacts with regard to noise, air quality, or water quality.

PURCHASE OF PARTS AND MATERIALS FOR PIPELINES\nIt is recommended that the City Council consider:\n(1) Awarding three-year contracts to five vendors: Core & Main, LP, S & J Supply Co., Inc.,\nSoCal Compton Pipe Supply, United Water Works and Western Water Works Supply Co.,\nin a form approved by the City Attorney, for a combined total not to exceed $500,000,\nannually, for the purchase of pipe supplies and related parts for the Water Division; and\n(2) Taking such additional, related, action that may be desirable.

3-H. 2022-23 STREET REHABILITATION AT VARIOUS LOCATIONS PROJECT – AWARD OF\nCONTRACT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a public works contract, in a form approved by\nthe City Attorney, with All American Asphalt of Corona, CA in the contract amount of\n$6,865,699 for the 2022-23 Street Rehabilitation at Various Locations Project;\n(2) Authorizing the Director of Public Works to approve change orders and contingency up to\n$1,029,855, or 15% of the contract amount for a total project cost of $7,895,554;\n(3) Accepting and appropriating anticipated reimbursement from the City of Rosemead in the\namount of $152,095 for costs related to their portion of work on New Avenue to the Capital\nImprovement Project No. 96031 budget; and\n(4) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nSince the proposed work is a minor alteration to an existing public facility, this project is Class 1\nCategorically Exempt pursuant to the California Environmental Quality Act (CEQA).

NOTICE OF COMPLETION – VARIOUS CAPITAL IMPROVEMENT PROJECTS\nIt is recommended that the City Council consider:\n(1) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nApril 27, 2023 accepting the 2022 Residential Street Rehabilitation Specification No. 2022-\n008 completed by All American Asphalt, Inc.;\n(2) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nApril 27, 2023 accepting the Emerson Avenue Sewer System CIPP Lining and Point\nRepair Improvements Specification No. 2022-007 completed by Sancon Technologies,\nInc.\n(3) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nMay 3, 2023 accepting the Sierra Vista Court Resurfacing project completed by Trueline\nConstruction and Surfacing Inc;\n(4) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nMay 11, 2023 accepting the Citywide CCTV Camera Specification No. 2022-001\ncompleted by Endeavor Advanced Solutions; and\n(5) Taking such additional, related, action that may be desirable.\nPage 4 of 410\nMonterey Park City Council Agenda, June 7, 2023 - Page 5

ADOPTION OF A RESOLUTION ADDING NEW USER FEES AND CHARGES RELATING TO\nPOTABLE WATER SERVICES INCLUDING, WITHOUT LIMITATION, RECONNECTION\nFEES FOR PREVIOUSLY DISCONNECTED WATER SERVICE\nIt is recommended that the City Council consider:\n(1) Opening a public hearing to receive public testimony;\n(2) Adopting a Resolution to add new user fees and charges regarding potable water service\nincluding, without limitation, reconnection fees; and\n(3) Taking such additional, related, action that may be desirable.

THE CITY IS REQUIRED TO CONDUCT A PUBLIC HEARING TO CONSIDER\nASSESSMENTS FOR THE CITYWIDE MAINTENANCE DISTRICT NO. 93-1 FOR FISCAL\nYEAR 2023-24 PURSUANT TO STREETS AND HIGHWAYS CODE §§ 22500, ET SEQ.\nIt is recommended that the City Council consider:\n(1) Opening the public hearing and receive documentary and testimonial evidence;\n(2) Closing the public hearing and adopt a Resolution authorizing the Levy and Collection of\nAssessments for Fiscal Year 2023-24 in Citywide Maintenance District No. 93-1 pursuant\nto Streets and Highways Code § 22587; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe proposed action is exempt from review under the California Environmental Quality Act (Cal.\nPub. Res. Code §§ 21000, et seq.; “CEQA”) and CEQA Guidelines (Cal. Code Regs. tit. 14, §§\n15000, et seq.) because it establishes, modifies, structures, restructures, and approves rates\nand charges for meeting operating expenses; purchasing supplies, equipment, and materials;\nmeeting financial requirements; and obtaining funds for capital projects needed to maintain\nservice within existing service areas. A CONTINUED PUBLIC HEARING TO CONSIDER INTRODUCTION AND FIRST READING\nOF ZONING CODE AMENDMENT NO. 23-01(ZCA-23-01), AN ORDINANCE AMENDING THE\nMONTEREY PARK MUNICIPAL CODE, CHAPTER 21.18, ENTITLED “AFFORDABLE\nHOUSING INCENTIVES – DENSITY BONUS” TO IMPLEMENT THE MONTEREY PARK\nHOUSING ELEMENT\nIt is recommended that the City Council consider:\n(1) Opening the continued public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing, introduce and waive first reading of Ordinance No. _____ amending Chapter\n21.18 (Affordable Housing Incentives – Density Bonus) to Monterey Park Municipal Code\nTitle 21 (Zoning) to implement the Monterey Park Housing Element; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe proposed Ordinance is exempt from additional environmental review under the California\nEnvironmental Quality Act (“California Public Resources Code §§ 21000, et seq., “CEQA”) and\nits implementing guidelines (14 California Code of Regulations §§ 15000, et seq.; “CEQA\nGuidelines”) for the following reasons: (1) it will not result in a direct or reasonably foreseeable\nindirect physical change in the environment (CEQA Guidelines § 15060(c)(2)); (2) there is no\npossibility that the Ordinance itself may have a significant effect on the environment (CEQA\nGuidelines § 15061(b)(3)); and (3) the Ordinance, by itself, does not constitute a “project” as\ndefined in the CEQA Guidelines (CEQA Guidelines § 15378). The Ordinance is for general\npolicies and procedure-making; any project governed by the proposed Ordinance would receive\na separate environmental evaluation and review. It can be seen with certainty that there is no\npossibility that the Ordinance may have a significant effect on the environment.

A CONTINUED PUBLIC HEARING TO CONSIDER INTRODUCTION AND FIRST READING\nOF ZONING CODE AMENDMENT NO. 22-01 (ZCA-22-01), AN ORDINANCE ADDING THE\nMONTEREY PARK MUNICIPAL CODE, CHAPTER 21.19, ENTITLED “INCLUSIONARY\nHOUSING” TO IMPLEMENT THE MONTEREY PARK HOUSING ELEMENT.\nIt is recommended that the City Council consider:\n(1) Opening a continued public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing to introduce and waive first reading of Ordinance No. _____ adding Chapter 21.19\n(Inclusionary Housing) to the Monterey Park Municipal Code to implement the Monterey\nPark Housing Element; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nPursuant to the California Environmental Quality Act (Public Resources Code § 21000, et seq.;\n“CEQA”) and its implementing regulations (14 Cal. Code of Regs. § 15000, et seq.; the "CEQA\nGuidelines”), the proposed Ordinance and Resolution (ZCA 22-01) are exempt from further\nCEQA review for the following reasons: (1) they will not result in a direct or reasonably\nforeseeable indirect physical change in the environment (CEQA Guidelines § 15060(c)(2)); (2)\nthere is no possibility that the Ordinance may have a significant effect on the environment\nbecause any potential, future, housing projects would undergo separate environmental review\n(CEQA Guidelines § 15061(b)(3)); and (3) the Ordinance and Resolution, by themselves, do not\nconstitute a “project” as defined in the CEQA Guidelines because they involve a policy action\nthat is legislative implementing affordable housing policy and affects prospective future housing\ndevelopment to comply with Housing Element Program 15 (CEQA Guidelines § 15378).\nPage 6 of 410\nMonterey Park City Council Agenda, June 7, 2023 - Page 7

A PUBLIC HEARING TO CONSIDER THE FOLLOWING: 1) ZONING CODE AMENDMENT\n(ZCA-23-03) TO ADOPT THE MARKET PLACE SPECIFIC PLAN (SP-23-01); 2) ZONE\nCHANGE (ZA-23-01) TO RE-ZONE PROPERTIES FROM THE REGIONAL SPECIALTY\nCENTER (R-S) ZONE WITH THE PLANNED DEVELOPMENT OVERLAY (P-D) ZONE TO\nTHE MARKET PLACE SPECIFIC PLAN (MPSP) ZONE; AND 3) DEVELOPMENT\nAGREEMENT (DA-23-01) TO AMEND IN ITS ENTIRETY A DEVELOPMENT AGREEMENT\nBETWEEN MONTEREY PARK RETAIL PARTNERS, LLC AND THE CITY OF MONTEREY\nPARK FOR PROPERTIES COLLECTIVELY OPERATING AS THE MONTEREY PARK\nMARKET PLACE, LOCATED AT 2000-5500 MARKET PLACE DRIVE, ALSO IDENTIFIED BY\nASSESSOR’S PARCEL NUMBERS 5275-003-024, 025, 027, 029, 030, 031, 037, AND 038.\nIt is recommended that the City Council consider:\n(1) Opening a public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing:\na. Introducing and waiving first reading of an Ordinance implementing a Zone Change\n(ZA-23-01) from the Regional Specialty Center (R-S) zone with the Planned\nDevelopment Overlay (P-D) zone to the Market Place Specific Plan (“MPSP”) zone\n(Exhibit B);\nb. Introducing and waiving first reading of an Ordinance approving a Development\nAgreement (DA-23-01) for the subject property (Exhibit C); and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe Project is consistent with the Supplemental Environmental Impact Report (“SEIR”) and\nStatement of Overriding Considerations certified (and adopted) by the City Council on\nDecember 19, 2012 via Resolution No. 11548 (State Clearinghouse No. 1999051058). None of\nthe elements set forth in Public Resources Code § 21166 or CEQA Guidelines § 15162 exists.\nAccordingly, no subsequent or supplemental Environmental Impact Report, Mitigated Negative\nDeclaration or Addendum is required to be prepared before adopting the Project. The Notice of\nConsistency is attached as Exhibit “B” to the draft Ordinances. Implementation of mitigation\nmeasures identified in the SEIR will be monitored as called for in the Mitigation Monitoring and\nReporting Program adopted on December 19, 2012.
