15. CONSIDERATION OF AWARDING A NON-EXCLUSIVE FRANCHISE AGREEMENT\nFOR POLICE TOWING SERVICES TO P & H ENTERPRISES, INC., DBA ANAHEIM\nFULLERTON TOWING, AND ADOPTION OF RESOLUTIONS ESTABLISHING\nFRANCHISE FEES AND SERVICE RATES IN CONNECTION THEREWITH\nPresented by Brad Geyer, Police Captain\nPurpose: Consideration of awarding a non-exclusive franchise agreement to procure\nprofessional towing services for the City and the Buena Park Police Department, and\nestablishing the rates for service and franchise fees associated with the City's towing\nprogram. There is no expense to the city associated with this item; however, by\napproving a non-exclusive franchise agreement the City will be able to start recovering\npartial costs of administering its towing program, as allowed under California Vehicle\nCode Section 12110 (b).\nRecommended Action: 1) Award a non-exclusive franchise agreement to P&H\nEnterprises, dba Anaheim Fullerton Towing Services to provide non-exclusive towing\nservices to the City and the Buena Park Police Department; 2) Authorize the City\nManager and City Attorney to make any non-monetary changes to the franchise\nagreement; 3) Authorize the City Manager and City Clerk to execute the franchise\nagreement; 4) Adopt a Resolution establishing franchise fees to reimburse the City for\ncosts of administering its towing program; and, 5) Adopt a Resolution establishing the\nrates and charges for towing services.\nMAYOR/CITY COUNCIL REPORTS & CALENDAR\na.
