5. CONSIDERATION OF AN URGENCY ORDINANCE, ENACTED PURSUANT TO\nGOVERNMENT CODE SECTION 65858, PLACING A TEMPORARY MORATORIUM\nON THE ISSUANCE OF PERMITS OR ENTITLEMENTS FOR ANY SELF-STORAGE\nPROJECT IN THE CITY – F2M23-7, O2M23-4816\nAt the June 26, 2023 City Council meeting, the City Council gave direction to agendize\nconsideration of a moratorium ordinance that would prohibit the approval of self-storage\nfacilities in the City. Government Code section 65858 allows for adoption by urgency\nordinance of temporary zoning restrictions to preserve the health, safety and welfare of\nresidents while more permanent regulation is being developed. Per that code section, the\ninitial temporary restriction lasts no longer than 45 days. The extension of the 45-day\nordinance and subsequent extensions require a public hearing. During the effective period\nof an interim zoning ordinance, the City cannot approve projects that violate the ordinance,\nalthough the City is still required to process applications during the period of the ordinance.\nThe proposed ordinance will preserve the status quo and enable City staff to further study\nthe need for and impact from self-storage businesses and allow the staff to return to the\nCouncil with options for additional regulation of such businesses. Staff is also seeking\ndirection from the City Council on language in the proposed draft ordinance; specifically,\nas to whether or not to exempt the two completed applications for new self-storage\nfacilities from the scope of the ordinance.\nRecommended Action: City Council:\n1. Find that the recommended action is exempt from the California Environmental\nQuality Act ("CEQA") as set forth in the attached Urgency Ordinance; and,\n2. Provide direction to staff as to whether to exempt pending applications for self-\nstorage and then consider adoption by a 4/5 vote of:\nOrdinance No. O2M23-4816: An Urgency Ordinance of the City\nCouncil of the City of Alhambra, California, enacted pursuant to\nCalifornia Government Code Section 65858, placing a temporary\nmoratorium on the issuance of permits or entitlements for any self-\nstorage project in the City\nIf adopted, this ordinance will go into effect immediately for a period of 45 days,\nand a public hearing will be scheduled for the Council’s August 28, 2023 meeting\nto consider whether or not to extend the term of the ordinance.\n4\n7-24-23\nPUBLIC HEARING
