34. FIRST READING OF AN ORDINANCE UPDATING CHAPTER 7.04, SECTION\n7.04.030(B), OF THE ALHAMBRA MUNICIPAL CODE BY DELETING LANGUAGE\nPERTAINING TO THE NUMBER OF RESIDENTIAL DOGS AND CATS AND\nINCORPORATING BY REFERENCE THE HIGHER LIMITS FOR RESIDENTIAL DOGS\nAND CATS ALLOWED BY THE COUNTY – F2M15-49, F2M23-7, O2M23-4814, M2M23-\n127\nAt the May 8, 2023 City Council meeting, Mayor Andrade-Stadler requested staff research\nthe number of permittable dogs and cats per residence. Currently, Alhambra residents\nare permitted to have two dogs and four cats, per Municipal Code Section 7.04.030. The\nCity of Alhambra, however, partners with the Los Angeles County Department of Animal\nCare and Control under a City-County Municipal Services Agreement for various animal\ncontrol functions. The limitations under the Los Angeles County Department of Animal\nCare and Control Title 10 - Animals, Section 10.20.038 – Residential Dogs and Cats –\nLimitations specify the following: “A. Dogs. It is unlawful to keep more than four dogs at\nany residence without an animal facility license. Each dog must be licensed. For purposes\nof this section, a service dog licensed under Section 10.20.090 and serving a person who\nis disabled within the meaning of Government Code section 12926 subsection (i) or (j) is\nnot counted toward the number of dogs kept or maintained. B. Cats. It is unlawful to keep\nmore than five cats at any residence without an animal facility license. Each cat must be\nlicensed and kept primarily indoors.” Based on the City’s intent to align residential cat and\ndog limitations with the County’s Animal Code Ordinance (ACO), staff is recommending\nstriking those provisions (Section 7.040.030 (B)) currently in the City’s Municipal Code\nand incorporating by reference the County’s limits of five cats and four dogs. In addition,\nstaff is recommending amending the contract currently underway between the City of\nAlhambra and the Los Angeles County Department of Animal Care and Control to reflect\nthe new limits.\n17\n7-24-23\nRecommended Action: City Council, by one motion, take the following actions:\n1. Declare introduced for its first reading the following ordinance entitled:\nOrdinance No. O2M23-4814: An Ordinance of the City Council of the City of\nAlhambra updating Chapter 7.04, Section 7.04.030(B), of the Alhambra\nMunicipal Code by deleting language pertaining to the number of residential\ndogs and cats and incorporating by reference the higher limits for residential\ndogs and cats allowed by the County\nwhich ordinance will return for a second reading and adoption at the next Council\nmeeting.\n2. Authorize the City Manager or Designee to amend the City’s contract with the Los\nAngeles County Department of Animal Care and Control for the purposes of\nestablishing the new limits of five cats and four dogs.
