9.m Covina Skate Park Project – Award of Contract to Spohn Ranch, Inc for an 133\nAmount Not-to-Exceed $1,249,000\nStaff Recommendation:\n1. Authorize the City Manager to execute a contract with Spohn Ranch, Inc in an\namount not-to-exceed $1,249,000 and dispense with competitive proposals\npursuant to Negotiated Contract Agreement per Covina Municipal Code Chapter\n2.54 and Public Contract Code Section 22038 (c);\n2. Authorize an amount of $187,350 (15%) as a contingency to cover the cost of\nunforeseen construction expenses;\n3. Adopt Resolution CC 2023-78 appropriating an additional $608,510 from\navailable Measure CC Fund Balance to be transferred into the Parks CIP for the\nconstruction of the project;\n4. Authorize the City Council to defer two (2) approved planned Park Capital\nImprovement Projects (Senior Center Monument Sign Project and the Covina\nPark Tennis Court Fencing Replacement Project) in the FY 2023-24 Capital\nImprovement Program that were proposed to be funded by Measure CC and\nutilize $250,000 from those projects towards the Covina Skate Park Project; and\n5. Authorize the City Manager to execute a Professional Services Agreement\nwith Siterep Construction Services to provide inspection services for the Covina\nSkate Park Project in an amount not-to-exceed $50,160.
