16. Consideration of a Resolution to Declare an Emergency for the Water Main Break and Street\nRepair on Eagle Ridge and Approval of Agreement with Big Ben Engineering, Inc. in an\nAmount Not-To-Exceed $719,398 (Strategic Plan Goal 5)\nCITY RECOMMENDATION: 1. Adopt a City Council Resolution entitled “A RESOLUTION\nOF THE CITY COUNCIL FINDING AND DECLARING, BY A FOUR-FIFTHS VOTE OF\nTHE ENTIRE CITY COUNCIL, THAT AN EMERGENCY EXISTS WHICH WILL NOT\nPERMIT THE COMPETITIVE SOLICITATION OF BIDS TO REPAIR A SIGNIFICANT\nWATER MAIN BREAK ON EAST EAGLE RIDGE NEAR THE INTERSECTION OF\nBEAVERBROOK LANE, AND AUTHORIZING THE CITY MANAGER TO AWARD\nCONTRACTS NECESSARY TO REPAIR AND REMEDIATE THE SAME;” 2. Approve an\nAgreement with Big Ben Engineering, Inc. for an Emergency Water Main Break and Street\nRepair on Eagle Ridge in an Amount Not-To-Exceed $719,398; 3. Authorize the City Manager\nand Director of Public Works to finalize negotiations for the emergency repairs, with a 20%\ncontingency, for a total not-to-exceed $719,398, that can be authorized by the City Manager to\nexecute change orders for unforeseen work during the performance of the emergency repairs;\nand 4. Adopt a Categorical Exemption from the California Environmental Quality Act Pursuant\nto Section 15071(b) and (c) of the California Code of Regulations.\nMEMBER/STAFF CLOSING COMMENTS
