NEW BUSINESS\nAt this time, members of the audience may ask to be heard regarding an item on New Business.\nA) Direction Regarding United Rock Products Request to Submit an Application to Modify\nthe Development Agreement for the Olive Pit\nDepartment: Community Development\nRecommendation: Discuss and authorize the City Manager to sign the application for the\nmodification of the Development Agreement for the Olive Pit, located at 4407 Azusa\nCanyon Road.\nB) Approval of Settlement Agreement between Five Points, LP and City of Irwindale\nregarding settlement of the lawsuit Five Points, LP vs. City of Irwindale, Los Angeles\nCounty Superior Court, Case No. 22STCV01394\nRecommendation: 1) Approve the Settlement Agreement between the City of Irwindale\nand Five Points, LP regarding settlement of the lawsuit Five Points, LP vs. City of Irwindale,\nLos Angeles County Superior Court, Case No. 22STCV01394, and 2) Authorize the City\nManager to execute the Settlement Agreement subject to City Attorney approval as to\nform with authorization to the City Manager to approve any non-substantive changes to\nthe agreement prior to execution.\nC) Request to approve Amendment No. 3 to the professional consulting contract with De\nNovo Planning Group for the preparation of an additional air quality analysis for the\nEnvironmental Impact Report for the construction of a ±495,000 square-foot concrete tilt-\nup building and associated parking at 5175 Vincent Avenue [APNS: 8417-034-015 and\n8417-034-016 as per the 2018 Assessor’s Parcel Map. (Formerly APNS: 8417-034-904,\n8417-034-910, 8417-034-911)]\nDepartment: Community Development\nRecommendation: Approve contract amendment No. 3 with De Novo Planning Group for\nthe preparation of additional air quality analysis for the proposed project at 5175 Vincent\nAvenue.
