19. FIRST READING OF AN ORDINANCE EXTENDING THE TERM OF ORDINANCE NO.\nO2M23-4812, A TEMPORARY MORATORIUM ON CERTAIN “NO FAULT”\nRESIDENTIAL EVICTIONS DUE TO A PROPERTY OWNER’S INTENT TO\nSUBSTANTIALLY REMODEL THE TENANT’S UNIT IN THE CITY OF ALHAMBRA\nAND DETERMINE THIS ACTION IS EXEMPT FROM CEQA – F2M23-7, O2M23-4812,\nO2M23-4822\nOn June 26, 2023, the City Council adopted Ordinance No. O2M23-4812, imposing a\ntemporary moratorium on so called “renovictions,” through December 31, 2023. On\nSeptember 30, 2023, SB 567 was signed by the Governor. SB 567 revises certain tenant\nprotections in State law which address the concerns that the City’s moratorium was\nintended to address. However, those protections do not take effect until April 1, 2024. At\nthe October 9, 2023 City Council meeting, the City Council directed that an amendment\nto Ordinance No. O2M23-4812 be agendized to extend the term of the temporary\nmoratorium on renovictions until the tenant protections of SB 567 become effective. The\nCity reviewed the environmental impacts of this Ordinance under the California\nEnvironmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the\nregulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). This Ordinance is not subject to further review environmental review\nbecause: (1) it will not result in a direct or reasonably foreseeable indirect physical change\nin the environment (14 Cal. Code Regs. § 15060(c)(2); (2) there is no possibility that this\nOrdinance themselves may have a significant effect on the environment (14 Cal. Code\nRegs. § 15061(b)(3)); and (3) the Ordinance, by itself, do not constitute a “project” as\ndefined in the CEQA Guidelines (14 Cal. Code Regs. § 15378). The Ordinance is for\ngeneral policies and procedure-making.\n\nRecommended Action: Declare introduced for its first reading the following\n\nordinance entitled:\nOrdinance No. O2M23-4822: An Ordinance of the City Council of the City of\nAlhambra, California, extending the term of Ordinance No. O2M23-4812, a\ntemporary Moratorium on certain “no fault” residential evictions due to a\nproperty owner’s intent to substantially remodel the tenant’s unit in the City of\nAlhambra which ordinance will return for a second reading and adoption at the next regular City\nCouncil meeting.
