AN APPEAL OF THE PLANNING COMMISSION'S JUNE 22, 2023 DECISION APPROVING A\nDEVELOPMENT PLAN REVIEW AND DENSITY BONUS PERMIT TO ALLOW FOR THE\nCONSTRUCTION OF A NEW SIX-STORY, MIXED USE DEVELOPMENT WITH GROUND FLOOR\nCOMMERCIAL USES AND 105 RESIDENTIAL DWELLING UNITS AT 55 NORTH LA CIENEGA\nBOULEVARD.\nA RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS CONDITIONALLY\nAPPROVING A DEVELOPMENT PLAN REVIEW AND DENSITY BONUS PERMIT TO ALLOW\nFOR A NEW SIX-STORY MIXED USE DEVELOPMENT WITH GROUND FLOOR COMMERCIAL\nUSES, 105 RESIDENTIAL DWELLING UNITS ON THE SECOND THROUGH FIFTH STORIES,\nAND ROOFTOP RESTROOMS ON THE SIXTH STORY AT 55 NORTH LA CIENEGA\nBOULEVARD, FINDING THE PROJECT EXEMPT FROM THE CALIFORNA ENVIRONMENTAL\nQUALITY ACT, AND DENYING A RELATED APPEAL.\nComment: On June 22, 2023, the Planning Commission adopted a resolution approving the construction\nof a new six-story, mixed use development with ground floor commercial uses and 105 residential\ndwelling units at 55 North La Cienega Boulevard. Subsequently, a timely appeal of the Planning\nCommission's decision was filed on July 5, 2023, by Lozeau Drury LLP, on behalf of Supporters Alliance\nfor Environmental Responsibility ("SAFER"). This item was continued from the September 12, 2023\nmeeting at the request of the applicant to address additional appeal objections filed by the appellant the\nday of the originally scheduled meeting. It is recommended that the City Council hold a de novo public\nhearing to consider the appeal and adopt a resolution approving the project, and finding the project\nexempt from the California Environmental Quality Act, and upholding the Planning Commission's decision\n(i.e., denying the appeal), which would allow the project to move forward through the City's architectural\nreview and building permit processes.
