1. Appeal of the Planning Commission's denial of CUP No. 857 authorizing the continued\noperation of a parcel delivery service at 9350 Rayo Avenue\nThe City Council will consider: (CD)\na. Conduct a public hearing, pursuant to South Gate Municipal Code Table 11.51-1 and Section\n11.50.040 (B);\nb. Consider accepting the determination that this matter is exempt from the California\nEnvironmental Quality Act;\nc. Consider adopting the findings as outlined in City Council Resolution No. _______\n(Attachment A); and\nd. Consider accepting Staffs strong recommendation to overturn the Planning Commission's\ndecision to deny Conditional Use Permit No. 857, and to adopt City Council Resolution No.\n_____, issuing that Permit.\nALTERNATIVE ACTION:\ne. Staff strongly recommends that the City Council take the action and adopt the Resolution\nspecified in paragraph "d" above. However, if the majority of the City Council chooses not to\nadopt that Resolution, then in order to establish a definitive record of the City Council's action on\nthe matter, the City Council can express its decision to uphold the Planning Commission's\ndecision to deny Conditional Use Permit No. 857 by adopting alternative City Council Resolution\nNo. _______ (Attachment B).
