16. A PUBLIC HEARING REGARDING AN ECONOMIC DEVELOPMENT SUBSIDY REPORT,\nRESOLUTION, AND OPERATING COVENANT AGREEMENT BETWEEN THE CITY OF ONTARIO\nAND HOME DEPOT U.S.A., INC.\nThat the City Council take the following actions:\nA. Adopt a Resolution accepting the Economic Development Subsidy Report prepared\npursuant to Government Code Section 53083.1 regarding an Operating Covenant\nAgreement with Home Depot U.S.A., Inc.;\nB. Adopt a Resolution approving the Operating Covenant Agreement and authorizing the\nCity Manager or his designee to execute the Agreement; and\nC. Direct City Staff to file a Notice of Exemption based upon the City Council’s finding that\nthe impacts for this Agreement is not a project and subject to environmental review and\nthat there is no possibility that the activity in question may have a significant effect on\nthe environment.\nA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ONTARIO, CALIFORNIA, ACCEPTING THE\nECONOMIC DEVELOPMENT SUBSIDY REPORT PREPARED PURSUANT TO GOVERNMENT CODE\nSECTION 53083 REGARDING AN OPERATING COVENANT AGREEMENT BY AND BETWEEN THE\nCITY OF ONTARIO AND HOME DEPOT U.S.A., INC.
