9. A RESOLUTION AUTHORIZING TRANSFER AND ACCEPTANCE OF PROPERTY\nLOCATED AT 5811-1/2 LIVE OAK STREET\n4\nConsideration of a resolution transferring property at 5811-1/2 Live Oak Street from Prime/Fit,\nLLC, to the Successor Agency to the former Bell Gardens Community Development Commission,\nfollowed by a transfer of the property to the City of Bell Gardens.\nRecommendation:\nIt is staff’s recommendation that the Successor Agency:\n1. Find the proposed transfer of the property located at 5811 1/2 Live Oak Street (APN: 6227-\n004-800) ("Property" or “Little Rectangle”) from Prime Frit El Portal, LLC, a California limited\nliability company (“Prime/Frit”) to the City of Bell Gardens as Successor Agency to the\nFormer Bell Gardens Community Development Commission (“Successor Agency”) is\nexempt from the California Environmental Quality Act, pursuant to CEQA Guidelines section\n15312.\n2. Adopt Successor Agency Resolution No. 2023-06, attached hereto as Exhibit 1, approving\nand accepting the transfer of the Property Prime/Frit to the City of Bell Gardens as\nSuccessor Agency to the Former Bell Gardens Community Development Commission\n(“Successor Agency”) by Quitclaim Deed (Exhibit A to the Successor Agency Resolution No.\n2023-06).\n3. Accept transfer of the Property by execution of a Certificate of Acceptance (Exhibit A to the\nSuccessor Agency Resolution No. 2023-06).\n4. Approve the subsequent transfer of the Property to the City of Bell Gardens (“City”) in order\nfor the City to maintain the current wireless lease on the Property, via Quitclaim Deed (Exhibit\nB to the Successor Agency Resolution No. 2023-06).\n5. Declare the Property as exempt surplus land under the Surplus Land Act pursuant California\nGovernment Code section 54221(f)(1)(D) as it will be transferred to local agencies, the\nSuccessor Agency and subsequently, the City, for use of the Property as a cell tower site.\nIt is also staff’s recommendation that the City Council:\n1. Find the proposed acceptance of the Property from the Successor Agency is exempt from\nthe California Environmental Quality Act pursuant to CEQA Guidelines sections 15312 and\n15061(b)(3).\n2. Adopt City Council Resolution No. 2023-111, attached hereto as Exhibit 2, approving and\naccepting the transfer of the Property from the Successor Agency by Quitclaim Deed via\nDeed (Exhibit A to the City Council Resolution No. 2023-111).\n3. Accept transfer of the Property by execution of a Certificate of Acceptance (Exhibit A to the\nCity Council Resolution No. 2023-111).\n4. Accept transfer of the overhang easement from Prime/Frit (Exhibit B to the City Council\nResolution No. 2023-111).
