GENERAL MOTION TO WAIVE FULL READING AND APPROVE ORDINANCES BY\nTITLE ONLY PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 36934\nIn order to expedite the conduct of business at City Council meetings, California State Law\n(California Government Code Section 36934) allows Ordinances to be read by title if a majority of\nthe legislative body supports the motion to waive the full reading.\nRecommendation:\nIt is staff's recommendation that the City Council approve a general motion to waive full reading and\napprove Ordinances by title only pursuant to California Government Code Section 36934.

A RESOLUTION AUTHORIZING ACCEPTANCE OF THE CALIFORNIA DEPARTMENT\nOF TRANSPORTATION SUSTAINABLE TRANSPORTATION PLANNING GRANT\nFUNDING\nConsideration of a resolution authorizing acceptance of the California Department of Transportation\nSustainable Transportation Planning Grant funding to a specific citywide project.\nRecommendation:\nIt is recommended that the City Council:\n1. Adopt a Resolution authorizing acceptance of the California Department of Transportation\nSustainable Transportation Planning Grant funding; and\n5\n2. Rescind Resolution No. 2023-083.

CONSIDERATION OF APPROVAL OF A RESOLUTION EXTENDING AN AMENDMENT\nTO THE GROSS REVENUE LICENSE FEE IMPOSED ON PARKWEST BICYCLE\nCASINO\nAdopt the attached Resolution extending an amendment to the gross revenue license fee imposed\non Parkwest Bicycle Casino for a limited time period ending on April 30, 2024.\nRecommendation:\nIt is staff's recommendation that the City Council adopt the attached Resolution extending an\namendment to the gross revenue license fee imposed on Parkwest Bicycle Casino for a limited\ntime period ending on April 30, 2024.

12. ACCEPTANCE OF THE 2022 SHSP GRANT FUNDING\nThe Police Department will be utilizing the 2022 State Homeland Security Program (SHSP) grant\nfunding to enhance cybersecurity equipment such as: hardware, computer(s), firewall systems,\nand/or mobile police vehicle radios. This equipment will reinforce security in an effort to prevent\ncyber-attacks.\nRecommendation:\nIt is staff’s recommendation that the City Council adopt the attached Resolution thereby accepting\ngrant funds and authorizing the Police Department to begin expending these funds.

13. RESOLUTION APPROVING A FOURTH AMENDMENT TO ENGINEERING SERVICES\nAGREEMENT WITH BOWMAN INFRASTRUCTURE ENGINEERS LTD. DBA\nINFRASTRUCTURE ENGINEERS TO EXTEND THE TERM FOR ONE ADDITIONAL\nMONTH\nConsideration of a Resolution approving a Fourth Amendment to the Engineering Services\nAgreement with Bowman Infrastructure Engineers Ltd. dba Infrastructure Engineers to extend the\nterm through January 31, 2024.\nRecommendation:\nIt is staff’s recommendation that the City Council adopt the attached Resolution authorizing the City\nManager to execute the Fourth Amendment with Bowman Infrastructure Engineers Ltd. dba\nInfrastructure Engineers.

APPROVAL OF SECOND AMENDMENT TO THE EXISTING AGREEMENT FOR CITY\nATTORNEY SERVICES WITH OLIVAREZ MADRUGA LAW ORGANIZATION, LLP\nConsideration of approval of Second Amendment to the existing agreement for City Attorney\n6\nServices with Olivarez Madruga Law Organization, LLP.\nRecommendation:\nIt is staff's recommendation that the City Council:\n1. Consider and approve the Second Amendment to the existing Agreement for City Attorney\nServices with Olivarez Madruga Law Organization, LLP, in accordance with Government\nCode Sections 53262, 54953(c)(3) and 54956(b); and\n2. Authorize the City Manager to make nonmaterial changes and execute all implementing\ndocuments.

16. LOCAL COMMISSIONS APPOINTMENT LIST\nThe Local Commissions Appointments List outlines the City of Bell Gardens Commissions and\nCommissioners. Per the Bell Gardens Municipal Code, City Commissions consist of Bell\nGardens residents appointed by each member of the City Council. Council Members may remove\ncommissioners during any regular City Council meeting and may appoint commissioners following\n10 working days after the posting of the vacancy notice.\nRecommendation:\nIt is staff's recommendation that the City Council review the Commissions Appointments List and\nby motion, remove commissioners and/or make appointments to the posted vacancies.

REORGANIZATION AND SELECTION OF MAYOR/CHAIRPERSON AND MAYOR PRO\nTEM/VICE CHAIRPERSON\nThe City Clerk will call for nominations and voting for Mayor/Chair and Mayor Pro Tem/Vice Chair of\nthe City of Bell Gardens City Council and Successor Agency to the Community Development\nCommission.\nRecommendation:\nIt is staff recommendation that the City Council by motion organize and select a Mayor/Chairperson\nand Mayor Pro Tem/Vice Chairperson at the first regular meeting in December per Bell Gardens\nMunicipal Code 2.04.020(c) and Government Code 36801.\nCITY COUNCIL / SUCCESSOR AGENCY MEMBER COMMENTS

WARRANT REGISTERS AND WIRE TRANSFERS\nIn approving the action of receiving and filing the warrant registers, the official minutes of the Bell\nGardens City Council should state that each individual member of the City Council is not voting on,\ninfluencing the outcome of, or participating in approving, accepting, receiving or filing any warrant\nwhich bears the name of the same council member, or pays for any costs or expenses, or\notherwise benefits the same named council member. Each council member will not be participating,\ninfluencing or voting on any such warrant bearing their name or which benefits the same named\ncouncil member, but with that exception is voting in favor of receiving and filing all other warrants\ncontained in this report, unless otherwise noted on the record at the time of the approval of the\naction required by this report.\nRecommendation:\nIt is staff's recommendation that the City Council receive and file the warrant registers, wire\ntransfers, and net payrolls dated 10/26/23, 10/31/23, 11/02/23, 11/07/23, 11/14/23, 11/16/23 and\n11/21/23.

SUCCESSOR AGENCY APPROVAL OF THE RECOGNIZED OBLIGATION PAYMENTS\nSCHEDULE 2024-25 AND THE JULY 1, 2024 – JUNE 30, 2025 ADMINISTRATIVE\nBUDGET\nAgenda item to present the ROPS 2024-25 and the fiscal year 2024-2025 Administrative Budget\nto the Successor Agency with a recommendation to adopt a resolution approving the ROPS 2024-\n2025 and the fiscal year 2024-2025 Administrative Budget.\nRecommendation:\nIt is staff's recommendation that the Successor Agency (SA) by motion adopt the attached\nResolution approving:\n1. Recognized Obligations Payment Schedule 24-25 (ROPS 24-25) which details the\nobligations of the SA for the period July 1, 2024 through June 30, 2025; and\n2. Proposed Administrative Budget for July 1, 2024 through June 30, 2025.

A RESOLUTION OF THE CITY OF BELL GARDENS ESTABLISHING A POLICY THAT\nDELEGATES TORT LIABILITY CLAIMS HANDLING RESPONSIBILITIES TO THE\nCALIFORNIA JOINT POWERS INSURANCE AUTHORITY (CJPIA) AS AUTHORIZED BY\nGOVERNMENT CODE SECTIONS 910, ET SEQ.\nDelegation of authority to the California Joint Powers Insurance Authority (CJPIA).\nRecommendation:\nIt is the staff’s recommendation that the City Council approve the attached Resolution, establishing\na policy that delegates tort liability claims handling responsibilities to the CJPIA as authorized by\nGovernment Code sections 910 et seq.

A RESOLUTION AUTHORIZING TRANSFER AND ACCEPTANCE OF PROPERTY\nLOCATED AT 5811-1/2 LIVE OAK STREET\n4\nConsideration of a resolution transferring property at 5811-1/2 Live Oak Street from Prime/Fit,\nLLC, to the Successor Agency to the former Bell Gardens Community Development Commission,\nfollowed by a transfer of the property to the City of Bell Gardens.\nRecommendation:\nIt is staff’s recommendation that the Successor Agency:\n1. Find the proposed transfer of the property located at 5811 1/2 Live Oak Street (APN: 6227-\n004-800) ("Property" or “Little Rectangle”) from Prime Frit El Portal, LLC, a California limited\nliability company (“Prime/Frit”) to the City of Bell Gardens as Successor Agency to the\nFormer Bell Gardens Community Development Commission (“Successor Agency”) is\nexempt from the California Environmental Quality Act, pursuant to CEQA Guidelines section\n15312.\n2. Adopt Successor Agency Resolution No. 2023-06, attached hereto as Exhibit 1, approving\nand accepting the transfer of the Property Prime/Frit to the City of Bell Gardens as\nSuccessor Agency to the Former Bell Gardens Community Development Commission\n(“Successor Agency”) by Quitclaim Deed (Exhibit A to the Successor Agency Resolution No.\n2023-06).\n3. Accept transfer of the Property by execution of a Certificate of Acceptance (Exhibit A to the\nSuccessor Agency Resolution No. 2023-06).\n4. Approve the subsequent transfer of the Property to the City of Bell Gardens (“City”) in order\nfor the City to maintain the current wireless lease on the Property, via Quitclaim Deed (Exhibit\nB to the Successor Agency Resolution No. 2023-06).\n5. Declare the Property as exempt surplus land under the Surplus Land Act pursuant California\nGovernment Code section 54221(f)(1)(D) as it will be transferred to local agencies, the\nSuccessor Agency and subsequently, the City, for use of the Property as a cell tower site.\nIt is also staff’s recommendation that the City Council:\n1. Find the proposed acceptance of the Property from the Successor Agency is exempt from\nthe California Environmental Quality Act pursuant to CEQA Guidelines sections 15312 and\n15061(b)(3).\n2. Adopt City Council Resolution No. 2023-111, attached hereto as Exhibit 2, approving and\naccepting the transfer of the Property from the Successor Agency by Quitclaim Deed via\nDeed (Exhibit A to the City Council Resolution No. 2023-111).\n3. Accept transfer of the Property by execution of a Certificate of Acceptance (Exhibit A to the\nCity Council Resolution No. 2023-111).\n4. Accept transfer of the overhang easement from Prime/Frit (Exhibit B to the City Council\nResolution No. 2023-111).
