71. Ballona Creek Bacteria Total Maximum Daily Load Project Agreement\nRecommendation: Acting as the Governing Body of the County Flood Control\nDistrict (District), and acting as a responsible agency for the Ballona Creek\nBacteria Total Maximum Daily Load Project (Project) (2), consider the\nEnvironmental Impact Report (EIR) prepared and adopted by the City of Los\nAngeles as the lead agency for the Project; certify that the Board has\nindependently reviewed, considered, and reached its own conclusions\nregarding the environmental effects related to the Project; and find that the\nproposed actions are within the scope of the Final EIR prepared by the City of\nLos Angeles as lead agency; and take the following additional actions:\n(Department of Public Works) APPROVE\nAuthorize the Director of Public Works, on behalf of the County, to enter\ninto a Memorandum of Agreement (MOA) with the Cities of Beverly Hills,\nCulver City, Inglewood, Los Angeles, and West Hollywood to contribute a\ntotal amount not to exceed $1,053,784.98 in Fiscal Year (FY) 2023-24\nfor planning, design, and construction costs associated with the Project;\nAuthorize the Director of Public Works, on behalf of the County, to\nexecute any necessary amendments, including extensions of term, to this\nMOA provided that any amendments do not increase the amount of the\nCounty funding contribution by more than 10%;\nAuthorize the Chief Engineer of the Los Angeles County Flood Control\nDistrict to enter into a MOA with the Cities of Beverly Hills, Culver City,\nInglewood, Los Angeles, and West Hollywood to contribute a total amount\nnot to exceed $1,500,000 in FY 2023-24 and 2024-25 for planning,\ndesign, and construction costs associated with the Project; and\nAuthorize the Chief Engineer of the Los Angeles County Flood Control District\nto execute any necessary amendments, including extensions of term, to this\nMOA provided that any amendments do not increase the amount of the Los\nAngeles County Flood Control District's funding contribution.
