RESOLUTION NO. - First Amendment to Contract DA-5605 with Swinerton Builders: In amount of $42,902,220, covering Phase 2A of the Landside Access Modernization Program Intermodal Transportation Facility Auxiliary Curbs Project at Los Angeles International Airport; and appropriation of $52,252,220 for said project \nPURPOSE: Approval of the First Amendment to Contract DA-5605 with Swinerton Builders enables commencement of Phase 2A of the Intermodal Transportation Facility (ITF) Auxiliary Curbs Project. Phase 2A includes, but is not limited to, early procurement of long lead time materials, buy out of critical construction packages, design completion, final permitting, hazardous materials remediation, and additional site investigations. The project will ultimately provide convenient and efficient passenger pick-up and drop-off areas at the Los Angeles International Airport (LAX) Economy Parking Facility and ITF East at LAX. \nRECOMMENDATIONS: Adoption of the Report requesting that the Board of Airport Commissioners determine that this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2.i of the Los Angeles City CEQA Guidelines; approve the First Amendment to Contract DA-5605 with Swinerton Builders, subject to change order authority by the Chief Executive Officer, as necessary; further approve a budgeted owner's contingency of $4,000,000 for Phase 2A of the project, whereas, to date, the Board of Airport Commissioners authorized $3,000,000 in project contingency for Phase 1, thereby bringing the total budgeted owner's contingency to $7,000,000, which can only be utilized through change orders authorized by the Chief Executive Officer, or designee; further approve appropriation of capital funds in amount of $52,252,220 for Phase 2A of the project, including, but not limited to, early procurement of long lead time materials, buy out of critical construction packages, design completion, final permitting, hazardous materials remediation, site investigations, owner-carried soft costs, and project contingency, whereas, staff will return to the Board of Airport Commissioners upon completion of the full and final Guaranteed Maximum Price proposal and request approval of a contract amendment for Phase 2B for the balance of construction of the project and appropriation of the associated funds; authorize the Chief Executive Officer, or designee, to approve and execute change orders to the contract up to the budgeted owner's contingency of $4,000,000 for Phase 2A of the project, provided that, prior to execution of any change order in excess of $1,000,000, the Board of Airport Commissioners shall first have reviewed and authorized execution thereof, and such authorization shall become final pursuant to Charter Section 245; and further authorize the Chief Executive Officer, or designee, to execute said First Amendment after approval as to form by the City Attorney.
