4. PUBLIC HEARING TO CONSIDER ADOPTION OF URGENCY ORDINANCE\nREGULATING MEDICINAL CANNABIS DELIVERY-ONLY RETAILERS – F2M23-78,\nN2M24-6, O2M23-4824, O2M24-4825\nThis is the time and place set by Notice No. N2M24-6 for the City Council to hold a public\nhearing to consider adoption of an Ordinance extending Ordinance No. O2M23-4824, an\ninterim urgency ordinance to implement California law governing medicinal cannabis\ndelivery-only retailers, for a period of 10 months and 15 days. The California Legislature\nadopted Senate Bill 1886 (“SB 1186”) in 2022, entitled the Medicinal Cannabis Patients’\nRight of Access Act, which precludes cities and counties from adopting or enforcing\n3\n1-22-24\nregulations that prohibit or have the effect of prohibiting the retail sale of medicinal\ncannabis by delivery. SB 1186 took effect on January 1, 2024. The City Council adopted\nOrdinance No. O2M23-4824 at its December 11, 2023 meeting establishing interim\nurgency regulations implementing. This ordinance is set to expire on January 25, 2024.\nThe proposed ordinance would extend the term of Ordinance No. O2M23-4824 for ten\nmonths and fifteen days in accordance with Government Code Section 65858, unless\nearlier repealed. An ordinance adopting permanent regulations has been prepared and\nthe Planning Commission has recommended Council adoption of the ordinance. City staff\nintends to notice this ordinance for a public hearing at the City Council after the Council\ntakes final action on the proposed comprehensive Zoning Code update.\nRecommended Action: City Council conduct a public hearing and, after receiving\npublic testimony, the Mayor should close the public hearing and the City Council adopt by\na 4/5th vote the following urgency ordinance entitled:\nOrdinance No. O2M24-4825: An Urgency Ordinance of the City Council of\nthe City of Alhambra, California, extending the term of Ordinance No.\nO2M23-4824, an Interim Urgency Ordinance to implement California law\ngoverning medicinal cannabis delivery-only retailers within the City\nafter which such ordinance shall go into effect immediately.\nPRESENTATION
