REQUEST FOR COUNCILMEMBER PARTICIPATION VIA VIDEO/TELECONFERENCE\nPURSUANT TO GOVERNMENT CODE SECTION 54953(F) – F2M23-7, M2M24-9\nOn October 9, 2023, Councilmember Andrade-Stadler requested that her Council\ncolleagues vote to allow her participation via video/teleconference at the January 22, 2024\nCity Council meeting due to medical reasons. Under current Government Code section\n54953(f), this is allowable action if approved by the City Council.\nRecommended Action: City Council consider approving Councilmember Andrade-\nStadler’s request by motion and vote to allow her to participate and vote remotely via\nvideo/teleconference in City Council meetings due to an emergency medical reason under\nGovernment Code Section 54953(f). 10. 2023 STRATEGIC PLAN UPDATE – F2M23-35\nOn April 24, 2023, the City Council approved the 2023 Strategic Plan following two special\nCity Council meetings that were conducted to review and update the goals and objectives\nthat were previously established in the 2021 Strategic Plan. Subsequently, staff provided\nquarterly updates throughout the year; this is the final update to the 2023 Strategic Plan.\nA full Strategic Plan planning session with the City Council, staff and a consultant is\ntentatively scheduled for March 13, 2024. This will provide opportunity to the Council to\nreview and update goals and objectives of the previous plan and establish the 2024\nStrategic Plan.\nRecommended Action: City Council receive and file the final update to the 2023\nAlhambra Strategic Plan.

SECOND READING AND ADOPTION OF ORDINANCE O2M23-4823 APPROVING\nZONING TEXT AMENDMENT AMD-23-10 (THE COMPREHENSIVE UPDATE TO THE\nCITY OF ALHAMBRA ZONING CODE [TITLE 23 OF THE ALHAMBRA MUNICIPAL\nCODE]) AND ZONING MAP AMENDMENT AMD-23-09 (AN AMENDMENT TO THE\nCITY OF ALHAMBRA OFFICIAL ZONING MAP); AND ADOPTION OF A RESOLUTION\nAPPROVING GENERAL PLAN TEXT AMENDMENT AMD-23-08 (AN AMENDMENT TO\nTHE LAND USE AND COMMUNITY DESIGN CHAPTER OF THE CITY OF ALHAMBRA\nGENERAL PLAN, VISION 2040), GENERAL PLAN MAP AMENDMENT AMD-23-07 (AN\nAMENDMENT TO THE CITY OF ALHAMBRA GENERAL PLAN LAND USE MAP), AND\nINITIAL STUDY/NEGATIVE DECLARATION – F2M20-24, O2M23-4823, R2M23-54\nAfter receiving staff’s presentation and public testimony at the November 13, 2023 public\nhearing and then continuing the public hearing to the December 11, 2023 meeting, the\nCity Council deliberated and determined which of the Planning Commission’s\nrecommendations to include and gave first reading to Ordinance No. O2M23-4823\napproving Zoning Text Amendment AMD-23-10 (The Comprehensive Update to the City\nof Alhambra Zoning Code [Title 23 of the Alhambra Municipal Code]) and Zoning Map\nAmendment AMD-23-09 (An Amendment to the City of Alhambra Official Zoning Map).\nAdditionally, the Council deliberated and determined which of the Planning Commission’s\nrecommendations to include in a Resolution approving General Plan Text Amendment\nAMD-23-08 (An Amendment to the Land Use and Community Design Chapter of the City\nof Alhambra General Plan, Vision 2040), General Plan Map Amendment AMD-23-07 (An\nAmendment to the City of Alhambra General Plan Land Use Map), and adopting the Initial\nStudy/Negative Declaration for the Project pursuant to the California Environmental\nQuality Act (CEQA). At the January 8, 2024 Council meeting, after further deliberation, the\nCouncil made further revisions to the Ordinance and Resolution. The Council then gave\nfirst reading to Ordinance No. O2M23-4823. Staff is requesting that the City Council\nintroduce O2M23-4823 for its second reading and adopt the ordinance as well as adopt\nthe related Resolution (R2M23-54).\nThe staff reports and attachments from all previous Planning Commission and City Council\npresentations on the Zoning Code, including the staff report and attachments prepared for\nthe public hearings on November 13th and December 11th, are available through the project\nwebsite at: https://www.alhambracodeupdate.com/participate.\nRecommended Action: City Council, by one motion, take the following actions:\n1. COMMENDATIONS: WINNERS OF THE 2023 HOLIDAY HOME DECORATING\nCONTEST – F2M24-3\nMayor Maza and the Alhambra City Council, on behalf of the citizens of Alhambra, wish\nto recognize and congratulate the winning contestants from the City’s 2023 Holiday Home\nDecorating Contest. This contest invited residents to show their sense of community and\nholiday spirit through the use of holiday decorations on their homes. The winners are to\nbe commended for displaying extraordinary efforts in enhancing and promoting a family-\noriented community through their colorful and imaginative holiday displays. COMMENDATIONS: SPARK OF LOVE TOY DRIVE – F2M24-3\nMayor Maza and the Alhambra City Council, on behalf of the citizens of Alhambra, wish\nto recognize and thank the Alhambra Fire Department team who were instrumental to the\nsuccess of this year’s Spark of Love Toy Drive. Their leadership and organization allowed\nthe City to serve over 600 families during the holiday season. Because of their efforts,\nchildren and families were able to experience the love and care of their community and\nshare the joy of the season. The City Council deeply appreciates the efforts of the Fire\nDepartment staff and all of the event’s participants who allow the City to continue the toy\ndrive, a wonderful tradition to serve families in our community. 4. PUBLIC HEARING TO CONSIDER ADOPTION OF URGENCY ORDINANCE\nREGULATING MEDICINAL CANNABIS DELIVERY-ONLY RETAILERS – F2M23-78,\nN2M24-6, O2M23-4824, O2M24-4825\nThis is the time and place set by Notice No. N2M24-6 for the City Council to hold a public\nhearing to consider adoption of an Ordinance extending Ordinance No. O2M23-4824, an\ninterim urgency ordinance to implement California law governing medicinal cannabis\ndelivery-only retailers, for a period of 10 months and 15 days. The California Legislature\nadopted Senate Bill 1886 (“SB 1186”) in 2022, entitled the Medicinal Cannabis Patients’\nRight of Access Act, which precludes cities and counties from adopting or enforcing\n3\n1-22-24\nregulations that prohibit or have the effect of prohibiting the retail sale of medicinal\ncannabis by delivery. SB 1186 took effect on January 1, 2024. The City Council adopted\nOrdinance No. O2M23-4824 at its December 11, 2023 meeting establishing interim\nurgency regulations implementing. This ordinance is set to expire on January 25, 2024.\nThe proposed ordinance would extend the term of Ordinance No. O2M23-4824 for ten\nmonths and fifteen days in accordance with Government Code Section 65858, unless\nearlier repealed. An ordinance adopting permanent regulations has been prepared and\nthe Planning Commission has recommended Council adoption of the ordinance. City staff\nintends to notice this ordinance for a public hearing at the City Council after the Council\ntakes final action on the proposed comprehensive Zoning Code update.\nRecommended Action: City Council conduct a public hearing and, after receiving\npublic testimony, the Mayor should close the public hearing and the City Council adopt by\na 4/5th vote the following urgency ordinance entitled:\nOrdinance No. O2M24-4825: An Urgency Ordinance of the City Council of\nthe City of Alhambra, California, extending the term of Ordinance No.\nO2M23-4824, an Interim Urgency Ordinance to implement California law\ngoverning medicinal cannabis delivery-only retailers within the City\nafter which such ordinance shall go into effect immediately.\nPRESENTATION

CHAMBER OF COMMERCE UPDATE – F2M21-43\nAlhambra Chamber of Commerce President, Mr. John Bwarie, will present an update for\nChamber of Commerce activities from March 2023 to December 2023.\nRecommended Action: City Council receive and order filed this informational report.\nCONSENT AGENDA (Item Nos. 6 – 13)\nAll items listed under the Consent Agenda are considered by the City Council to be routine and\nwill be enacted by one motion unless a citizen or Council member requests otherwise; in which\ncase, the item will be removed for separate consideration.

6. APPROVAL TO AMEND CONTRACT FOR PARKING HEARING OFFICER SERVICES\n– F2M24-16, K2M18-385, M2M24-11\nOn January 1, 2019, the City entered into an agreement (K2M18-385) with Joseph Malette\nto conduct Parking Hearing Officer services for two years in an amount not to exceed\n$45,000. The term of the agreement has since been amended to extend the term through\nJune 30, 2024; however, there has not been an increase to the contract amount. The\nproposed amendment for an additional $30,000 will result in a total contract amount of\n$75,000. The services under this contract are highly specialized; therefore, amending the\ncontract would be in accordance with the provisions cited under section 3.38.050 for the\nAlhambra Municipal Code. The proposed amendment also extends the term of the\nagreement through June 30, 2027.\n4\n1-22-24\nRecommended Action: City Council approve a contract amendment, subject to final\nlanguage approval by the City Manager and City Attorney, to the agreement between the\nJoseph Mallette and the City of Alhambra for ongoing Parking Hearing Officer services,\nnot to exceed an additional $30,000 through June 30, 2027; and, direct staff to undertake\nthe steps necessary to finalize Council’s action. AWARD CONTRACT & APPROPRIATE FUNDS: PYROTECHNICS SERVICES FOR\nTHE ALHAMBRA FOURTH OF JULY CELEBRATION – F2M23-75, RFP2M23-27,\nC2M24-6, M2M24-12\nOn November 13, 2023, the City Council approved the distribution of a Request for\nProposals (RFP) for Pyrotechnics Services for the Alhambra 4th of July Celebration. On\nNovember 27, 2023, the Parks & Recreation Department received one proposal in\nresponse to the RFP. The 3-year proposal received was $120,000 (2024 for $40,000,\n2025 for $40,000 and 2026 for $40,000). An expenditure in the amount of $20,000 for the\n2024 fireworks show must be approved for the City to enter into a contract with Garden\nState Fireworks, Inc. The total expenditure will be charged to multiple fiscal years.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, to Garden State Fireworks, Inc. in an\namount not to exceed $40,000 in 2024, $40,000 in 2025 and $40,000 in 2026 for the\nannual 4th of July Celebration; instruct the Director of Finance to pay 50% of this year’s\ncosts ($20,000 for 2024) in FY 2023-24 and pay the remainder of the $40,000 as an\nexpenditure in FY 2024-25 in account number 101.60.6110.66314; and, direct staff to\nundertake the steps necessary to finalize Council’s action. AWARD CONTRACT: POOL DECK COATING AT THE ALHAMBRA AND GRANADA\nPARK POOLS – F2M23-65, N2M23-109, C2M24-7, M2M24-13\nOn September 11, 2023, the City Council approved the distribution of a Notice Inviting\nBids for the Alhambra and Granada Park Pools Deck Coating Project. On September 28,\n2023, staff led a mandatory job walkthrough and four contractors attended this pre-bid site\nwalk. On October 26, 2023, the City Clerk received one bid for the Project. The bid\nreceived from Empire Waterproofing Inc. is within the grant award limits. The project will\nbe funded with American Rescue Plan Act (ARPA) funds.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, to Empire Waterproofing Inc. in the\namount of $428,445 for the Alhambra and Granada Park Pools Deck Coating Project; and,\ndirect staff to undertake the steps necessary to finalize Council’s action. AWARD CONTRACT: DESIGN SERVICES FOR PREPARATION OF ADAPTIVE\nTRAFFIC/TRAFFIC RESPONSIVE UPGRADES PROJECT - PHASE 1 – F2M23-47,\nRFP2M23-17, C2M24-8, M2M24-14\nThe City was awarded funding through the Los Angeles County Metropolitan\nTransportation Authority (LACMTA) for four traffic signal improvement projects within the\nCity of Alhambra (Project ID# MR 1.3.2.01 Atlantic, MR 1.3.1.02 Fremont, MR 1.3.1.01\n5\n1-22-24\nGarfield, and MR 1.3.2.06 Valley). The City released a Request for Proposals (RFP) and\nreceived four proposals for the preparation of Phase 1 of the City’s Adaptive Traffic/Traffic\nResponsive Control Systems Project. Following an extensive selection process, staff\nselected Advantec Consulting Engineers, Inc. as the most qualified consultant for this\nwork. Staff requests the City Council approve an agreement with Advantec Consulting\nEngineers, Inc., in an amount not to exceed $231,008. Phase 1 consists of the\ndevelopment of the preliminary design concepts of traffic elements and identification of\nactual locations for the project. Phase 2 consists of the preparation of actual engineering\ndesigns and plans, estimates, and specifications for implementation of all improvements\nas developed in Phase 1. The Project is located along the four major corridors of Atlantic\nBoulevard, Fremont Avenue, Garfield Avenue and Valley Boulevard. There are 62\nsignalized intersections along these four corridors.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, to Advantec Consulting Engineers, Inc.\nin an amount not to exceed $231,008 to prepare Phase 1 of the City’s Adaptive\nTraffic/Traffic Responsive Control Systems Project; and, direct staff to undertake the steps\nnecessary to finalize Council’s action.
