1. Public Hearing to consider all protests against a proposed sewer rate increase, as\nrequired by Article XIII D of the California Constitution (added in 1996 by prop. 218) and\nadopt a Resolution imposing that increase unless written protests by a majority of owners\nor tenants of affected properties are presented\nThe City Council will consider: (PW)\na. Conducting a public hearing pursuant to Section 6(a)(2) of Article XIII D of the California\nConstitution regarding the proposed sewer fee rate increases for which on November 14, 2023,\nthe City mailed notifications to all real properties affected by the proposed increase to notify\nproperty owners or tenants receiving sewer service about the proposed rate increase;\nb. During the Public Hearing, consider all protests against the proposed increases;\nc. If written protests against the proposed increases are presented by the owner or tenant of a\nMAJORITY of the affected parcels of real property, comply with said Article XIII D by resolving to\nNOT increase the fee; and\nd. If written protests against the proposed fee are presented by the owners or tenants of LESS\nTHAN A MAJORITY of the affected parcels of real property, resolve to INCREASE the fee as\nauthorized by said Article XIII D.
