14. CONSIDERATION OF AN ORDINANCE APPROVING AN UPDATED AB 481 POLICY\nAND APPROVAL OF ANNUAL MILITARY EQUIPMENT REPORT – F2M22-41, O2M24-\n4827, M2M24-23\nOn April 25, 2022, the City Council adopted Ordinance No. O2M22-4803 approving a\nMilitary Equipment Use Policy (“Policy”) pursuant to assembly Bill 481 (“AB 481”). In\naccordance with the legislation and the Policy, a military equipment report must be\nsubmitted to the City Council annually for each type of military equipment approved within\none year of approval, and annually thereafter for as long as the military equipment is\navailable for use. Alhambra’s 2023 Annual Military Equipment Report, proposed 2024\nmilitary equipment purchases, and the Police Department’s updated policy are outlined in\nthe Chief of Police’s staff report dated February 12, 2024. AB 481 requires that the Council\ndetermine, based on the annual military equipment report submitted pursuant to Section\n7072, whether each type of military equipment identified in that report has complied with\nthe standards for approval set forth in Government Code section 7071(d). Staff reviewed\nDepartment records and determined there were no complaints or concerns reported on\nthe use of the equipment in 2023. Additionally, the Department conducted an internal audit\nand determined that there were no violations of the Military Equipment Use Policy.\nRecommended Action: City Council, by one motion, take the following actions:\n1. Declare introduced for its first reading the following ordinance entitled:\nOrdinance No. O2M24-4827: An Ordinance of the City Council of the City of\nAlhambra implementing AB 481 by approving an updated policy for the use of\nmilitary equipment by the Alhambra Police Department\nwhich ordinance will return for a second reading and adoption at the next regular\nCouncil meeting; and,\n8\n2-12-24\n2. Approve the Alhambra Police Department’s Annual Military Equipment Report set\nforth in the Chief of Police’s February 12, 2024 report per the requirements under\nAssembly Bill 481. (M2M24-23)
