D. WITHDRAWAL OF RESOLUTION OF NECESSITY WITH RESPECT TO OPEN SPACE PROPERTY LOCATED SOUTHEAST OF AVENIDA PICO, ASSESSOR’S PARCEL NUMBERS 688-011-01 AND 688-011-02 Staff Recommendation Adopt Resolution No. 23-59, which will: 1. Withdraw Resolution of Necessity 20-27. 2. Authorize and direct staff to withdraw the Notice of Pendency of Action (Lis Pendens) and seek the release of the funds on deposit with the California State Treasurer. 3. Authorize and direct staff to take those actions that are necessary and proper in connection with dismissal of the eminent domain action and to accomplish the purpose and intent of the Resolution in a timely and expeditious fashion .
