J. RATIFICATION OF AN EMERGENCY CONTRACT AND FIRST AMENDMENT THERETO - TEMPORARY EMERGENCY SLOPE STABILIZATION REPAIRS AT CASA ROMANTICA Staff Recommendation Adopt Resolution No. 23-63, which will: 1. Make a finding that an emergency exists due to the potential failure of an existing slope and that the situation requires immediate action to prevent or mitigate impairment to property and public services that might otherwise occur if required to incur delays attributed to the typical engineering analysis and competitive bidding process. 2. Declare that the public interest and necessity demand the immediate expenditure of public funds to safeguard public health. 3. Approve a supplemental appropriation in the amount of $350,000 to Account No. 001-481-43470-000-23502 from the General Fund unassigned fund balance. 4. Ratify Construction Contract No. C23-38 and Amendment No. 1 to Contract No. C23-38, by and between the City of San Clemente and Alliance Diversified Enterprises, Inc., providing for emergency temporary slope stabilization repairs at Casa Romantica, on a time and materials basis for up to $350,000.
