Presentation of Draft report of the City of Encinitas\nSewer Rate Cost of Service Study (Study) for the\nCardiff Sanitary Division (CSD) and the Encinitas\nSanitary Division (ESD) and initiation of Proposition\n218 rate setting process. Environmental\nConsiderations: The action being considered by the\nCity Council is exempt from the California\nEnvironmental Quality Act (CEQA) because it is not a\n"project" under Section 15378(b)(5) of CEQA\nGuidelines. The action involves an organizational or\nadministrative activity of government that will not result\nin the direct or indirect physical change in the\nenvironment. Contact Person: Senior Management\nAnalyst Elmore\nRecommended Action: 1) Adopt the draft Study as\nfinal; 2) Authorize mailing of notices to ratepayers, as\nrequired by Proposition 218; 3) Schedule a public\nhearing on April 24, 2024, to: a) Review written\nprotests and consider adoption of Sewer Rates, as\nrequired by Proposition 218; b) Consider adoption of\nCapacity Fees (escalated annually to adjust for\nconstruction cost inflation); and 4) Introduce\nOrdinance No. 2024-01 titled, "An Ordinance of the\nCity Council of the City of Encinitas, California,\nAmending Encinitas Municipal Code Chapter 18.08\nRegarding Sewer Connection Fees and Sewer\nService Charge."\n2024-02-28 Item 10A Sewer Rate Study Prop 218\nAuthorization
