(Continued) Hearing to Review Bidder Protests and Authorize the Award\nof Construction Contract for the Barnes Park Multi-Benefit Stormwater\nCapture Project (City Project No. CIP 21-198)\nIt is recommended that the City Council:\n1. Reject the bid protest submitted by KASA Construction; and\n2. If the City Council believes that Zusser Company, Inc. (“Zusser”) has\nprovided sufficient evidence to rebut the concerns that it is a non-\nresponsible bidder, the City Council should award the contract for\nthe Project to Zusser;\n3. Alternatively, if the Council believes that Zusser has not provided\nsufficient evidence to rebut concerns that it is a non-responsible\nbidder, the City Council should award the contract to Nationwide\nContracting Services, Inc. Company of Huntington Beach, CA in the\namount of $17,199,044.00 (and Authorize the Mayor and City Clerk\nto execute the contract with Nationwide Contracting Services, Inc);\nand\n4.
