2-A. COMPLIANCE REVIEW OF DEVELOPMENT AGREEMENT NO. 2261-AA DATED OCTOBER 6, 2021 REGULATING REAL PROPERTY AT 100-200 SOUTH GARFIELD AVENUE (THE “PROJECT”) It is recommended that the City Council consider: (1) Receiving and filing this report (NOTE: any alterations to the project proposed by Rykadan 005, LLC must be processed in accordance with applicable law, i.e., the City Council may not “approve” any changes requested by the developer); and (2) Taking such additional, related, action that may be desirable. CEQA (California Environmental Quality Act): These actions are exempt from additional review under the California Environmental Quality Act (California Public Resources Code §§ 2100, et seq., “CEQA”) and CEQA Guidelines (14 California Code of Regulations §§ 15000, et seq.) pursuant to CEQA Guidelines § 15061(b)(3) the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment applies to the recommended action. It can be seen with certainty that there is no possibility that the proposed action has a significant effect on the environment.
