10. First reading and introduction of a Ordinance No. 1517 amending the Definitions Section 153.220.240 of the City of Baldwin Park's Municipal Code relating to Warehouses and Wholesale Sales and to revise Table 153.050.020 as it relates to permitted and conditionally permitted uses in the Industrial "I" and Industrial Commercial "I-C" zones and finding the action to be exempt from CEQA. It is recommended that the City Council: 1. Conduct a public hearing. 2. Find the proposed ordinance is exempt from environmental review under the California Environmental Quality Act (Pub. Resources Code, §§ 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (Cal. Code Regs, tit. 14, §§ 15000 et seq.). Specifically, the ordinance is categorically exempt from CEQA under Guidelines Section 15061(b)(3) (Common Sense Exception) since the adoption of an ordinance is not a “project” and can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment, either directly or indirectly, and that therefore no environmental review under CEQA is required. 3. Introduce by first reading, by title only and waive further reading, Ordinance 1517, entitled: “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK TO AMEND SECTION 153.220.240 OF THE MUNICIPAL CODE RELATING TO WAREHOUSES AND WHOLESALE SALES AND REVISE TABLE 153.050.020 IN THE CITY’S MUNICIPAL CODE AS IT RELATES TO PERMITTED AND CONDITIONALLY PERMITTED USES IN THE INDUSTRIAL “I” AND INDUSTRIAL COMMERCIAL “I-C” ZONES AND FINDING THE ACTION EXEMPT FROM CEQA PURSUANT TO SECTION 15060(b)(3) OF THE CEQA GUIDELINES”.
