First reading and introduction of a Ordinance No. 1517 amending the\nDefinitions Section 153.220.240 of the City of Baldwin Park's Municipal\nCode relating to Warehouses and Wholesale Sales and to revise Table\n153.050.020 as it relates to permitted and conditionally permitted uses in\nthe Industrial "I" and Industrial Commercial "I-C" zones and finding the\naction to be exempt from CEQA.\nIt is recommended that the City Council:\n1. Conduct a public hearing.\n2. Find the proposed ordinance is exempt from environmental review\nunder the California Environmental Quality Act (Pub. Resources\nCode, §§ 21000 et seq.) (“CEQA”) and the State CEQA Guidelines\n(Cal. Code Regs, tit. 14, §§ 15000 et seq.). Specifically, the\nordinance is categorically exempt from CEQA under Guidelines\nSection 15061(b)(3) (Common Sense Exception) since the adoption\nof an ordinance is not a “project” and can be seen with certainty that\nthere is no possibility that the ordinance may have a significant\neffect on the environment, either directly or indirectly, and that\ntherefore no environmental review under CEQA is required.\n3. Introduce by first reading, by title only and waive further reading,\nOrdinance 1517, entitled: “AN ORDINANCE OF THE CITY\nCOUNCIL OF THE CITY OF BALDWIN PARK TO AMEND\nSECTION 153.220.240 OF THE MUNICIPAL CODE RELATING TO\nWAREHOUSES AND WHOLESALE SALES AND REVISE TABLE\n153.050.020 IN THE CITY’S MUNICIPAL CODE AS IT RELATES\nTO PERMITTED AND CONDITIONALLY PERMITTED USES IN\nTHE INDUSTRIAL “I” AND INDUSTRIAL COMMERCIAL “I-C”\nZONES AND FINDING THE ACTION EXEMPT FROM CEQA\nPURSUANT TO SECTION 15060(b)(3) OF THE CEQA\nGUIDELINES”.\nREPORTS OF OFFICERS

3. Claim Rejections\nStaff recommends that the City Council reject the following claims and\ndirect staff to send the appropriate notice of rejection to claimants:\n• Sarah D. Guerra The claimant alleges property damage.\n• Walberto Zazueta The claimant alleges property damage.\n• Nuelito Protaci The claimant alleges property damage.\n• Leo Herrera The claimant alleges property damage.\n• Marcelo Sanchez The claimant alleges property damage.\n• Roger E. Briceno The claimant alleges property damage.\nThis government claim, and all government claims, should be considered\nas potential lawsuits in the future. Thus, it is requested that all City Staff,\nthe Mayor and all Council Members refrain from making any statements,\nwhether public or private in nature. It is important that no statements be\nmade so as to not prejudice this claim in any way which can happen if\npublic or private comments are made about this claim by City staff or\nCouncil Members.

5. Amendment to the Requisition of the Eleven (11) New Police Vehicles to\nthe City’s Lease Program – Approved on March 6, 2024 (Agenda Item #8)\nIt is recommended that the City Council:\n1. Review and approve the amendment of the estimated payment plan;\nand\n2. Authorize the Director of Finance to make necessary appropriation\nand budget adjustment in the Measure BP (Fund #110).

Approve Memorandum of Understanding between the City of Baldwin\nPark and the Department of Recreation and Community Services Trust for\nActivity #6 of Permanent Local Housing Allocation Funds\nIt is recommended that the City Council:\n1. Approve the MOU between the City of Baldwin Park and the RCS\nfor the PLHA Funds - Housing Trust Match in the amount of\n$366,949.12; and\n2. Authorize the CEO and the Director of Recreation & Community\nServices to execute the MOU and necessary documents associated\nwith the PLHA Funds; and\n3. Authorize the Director of Finance to make appropriations, including\npayments, upon receipt of funding from the Department of Housing\n& Community Development (HCD).

Approval of an Appropriation of Funds for Extraordinary and Unscheduled\nRepair Cost Related to Traffic Signal and Street Lighting Maintenance\nProgram\nIt is recommended that the City Council:\n1. Approve the appropriation of $29,640 for the Traffic Signal and\nStreet Lighting Maintenance Program;\n2. Authorize the Director of Finance to appropriate $29,640 from Fund\n#251 – Landscape Lighting Maintenance District (LLMD) and make\nnecessary budget adjustments to cover the repairs; and\n3. Authorize the Acting Director of Public Works, or his designee, to\ncomplete all the proper documentation to process purchase\nrequisition for purchase order for Yunex LLC. in the amount of\n$29,640.00 for the additional repair work to be completed.

Approval of Landscape Maintenance Agreement and Amendment No. 1 to\nFreeway Maintenance Agreement with Caltrans in relation to Barnes Park\nProject (CIP 21-198) and Caltrans Permit No. 07-23-N-MC-1333\nIt is recommended that the City Council:\n1. Approve the Landscape Maintenance Agreement; and\n2. Approve Amendment No. 1 to the Freeway Maintenance Agreement\nwith Caltrans for the Barnes Park Project (CIP 21-198); and\n3. Conduct a public hearing.\n2. Find the proposed ordinance is exempt from environmental review\nunder the California Environmental Quality Act (Pub. Resources\nCode, §§ 21000 et seq.) (“CEQA”) and the State CEQA Guidelines\n(Cal. Code Regs, tit. 14, §§ 15000 et seq.). Specifically, the\nordinance is categorically exempt from CEQA under Guidelines\nSection 21080.17, which exempts the adoption of an Accessory\nDwelling Unit ordinance to implement the provisions of Section\n66310, et. seq. of the Government Code, and that therefore no\nenvironmental review under CEQA is required.\n3. Introduce by first reading, by title only and waive further reading,\nOrdinance 1513, entitled: “AN ORDINANCE OF THE CITY\nCOUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA\nAMENDING THE BALDWIN PARK MUNICIPAL CODE, TITLE XV,\nLAND USAGE, CHAPTER, 153, ZONING CODE, SECTIONS\n153.040.070, 153.070.020, 153.120.350, 153.120.360 AND\n153.120.370 RELATING IN COMPLIANCE WITH CHANGES TO\nSTATE ACCESSORY DWELLING UNITS LAW ENACTED UNDER\nASSEMBLY BILL 2221, SENATE BILL 897, SENATE BILL 477,\nASSEMBLY BILL 2533, AND SENATE BILL 1211 AND FINDING\nTHE ACTION TO BE STATUTORILY EXEMPT FROM CEQA\nUNDER PUBLIC RESOURCES CODE § 21080.17 ”.
